Before this Office is a Complaint filed on May 08,2012’by Abe L. Sumabat (complainant) for violation of Section 3(a),(e), and (g) of RA No. 3019;RA No.9184’ and Article 217 of the Revised Penal Code (Malversation of Public Funds) against the following respondent:

The elements common to all acts of malversation under Article 217 are:

(1)  that the offender be a public officer,

(2)  that he bad the custody or control of funds or property bt reason of the duties of his office

(3)  that those funds or property were public funds or property for which he was accountable; and

(4) that  he appropriated,took,misappropriated or consented or through abandonment or negligence, permitted another person to take such public funds or property.

There is no evidence regarding any  of respondents’actual receipts or custody of the misappropriated proceeds of the trolley bag contract. More specifically, the essential elements of custody and accountability for the subject funds cannot be determined based on the evidence submitted by complainant. In addition, the newspaper article stating that 40,000 pieces of trolley bags were delivered to the City government, the photographs and distribution report submitted by respondents all show that there were in fact trolley bags that were distributed to the beneficiaries.

WHEREFORE, this Office:

(a) FINDS PROBABLE CAUSE to indict respondents ALDRIN SAN PEDRO,ROBERTO M. BUNYI,MICHAEL M. RACELIS,AVELINO A. ORELLANA, RODOLFO I.OLIQUINO, VICENTE A. NAVARRO,PETER B.SALONGA, SONIA S. LAURETA, RODERICK F.ESPINA,EDWIN T. SUITADO, EDUARDO D.BAUTISTA and GLENN M. SANTOS, acting in concert,for VIOLATION OF SECTION 3 (E) OF R.A. NO. 3019 in relation to the purchase of 40,000 pieces trolley bags CLMP Trading, amounting to at least PHP20,821,428.58 as reflected in Disbursment Voucher No. 012008010035;

 Accordingly, it is RECOMMENDED that the corresponding Information be immediately filed against them with the Sandiganbayan;

(b) DISMISSES the criminal charges against NELIA A. BARLIS, ROMEO M. PUCYUTAN, ELVIRA D. TULAY, MARISSA B. GUERRERO,ELIZA P.MENDOZA, ALLAN REY A. CAMILLON,MA. LUUISA A.BABARAN-ECHAVEZ, MARGARITA AMYTHYST PATDU-LABIOS, MELCHOR R. TEVES, ICASIANO M. DELA REA, FRANCIS IAN BAGATSING, MAMERTO T. SEVILLA, ROBERT A. ABAS, JOSELITO V. AREVALO,VERGIL C. ULANDAY, and REY E. BULAY for insufficiency of evidence; and

(c) DISMISSES the charges for violation of Sections 3 and (a) and (g) of R.A.3019; violation of R.A.9184 and Malversation under Article 217 of the Revised Penal Code  aginst ALL RESPONDENTS for insufficiency of evidence. Likewise,the charges against CESAR PAGKALINAWAN are dismissed by reason of his demise
