Attention: PNP ito ang MOA natin sa NPC…

UPANG higit na mabigyang-linaw ang proseso ng batas sa pagsisilbi ng arrest warrant partikular sa mga miyembro ng media na nahaharap sa kasong Libel ay sinikap nating magsaliksik ng existing law tungkol dito.

Isantabi ko muna ang tungkol sa Memoradum of Agreement (MOA) sa pagitan ng Philippine National Police (PNP) at National Press Club (NPC). Dahil ako man ay naguguluhan sa mga magkakaibang nakasulat sa naturang kasunduan sa ilalim ng termino ni ex-NPC President Louie Logarta at ex-NPC President Jerry Yap.

Ito na lang… ang nahalungkat ko sa lumang baul ng existing laws ang ipakikita ko sa ating arresting officers (mula sa PNP o NBI) at para na rin sa kaalaman ng mga kapwa ko mamamahayag na kadalasan ay biktima ng harassment sa kasong Libel:

Memorandum Circular No. 3

To: All officials and employees of the National Bureau of Investigation (NBI) and Operation Warrants of  Arrest (OWA)

Warrants of arrest should be served with the most careful adherence to the protections which the Constitution affords the individual citizen. In particular, it should be constantly borne in mind that the Constitution provides that in all criminal prosecutions, the accused shall be presumed innocent until the contrary is proved. It likewise provides that no person should be deprived of liberty without due process of law.

To ensure that these constitutional protections shall not be jeopardized, utmost care should be observed in serving warrants of arrest. Most specifically, no arrest should be made during nightime, on holidays, or on weekends except as stated below. This prohibition is intended to avoid inconveniences on the part of the arrested person, who otherwise might find it difficult to post bond for his provisional liberty, or to secure the services of legal counsel while under detention.

To reiterate, henceforth no arrests shall be effected during night-time, on holidays, or on weekends except only in cases of: citizen’s arrest; arrest of persons made as a result  of surveillance and/or entrapment operations; persons being arrested for subversion and other crimes and offenses against national security; notorious and dangerous criminals for whom outstanding warrants of arrest have been issued; and escapists and fugitives from justices.

Sa MOA naman sa pagitan ng PNP at NPC sa ilalim ng termino ni Logarta, napagkasunduan na ang isang miyembro ng media na may warrants of arrest sa Libel ay hindi maaring arestuhin nang hindi ipinagbigay-alam sa NPC; hindi maaring basta aarestuhin kung ito’y nasa gusali ng NPC nang walang koordinasyon sa presidente ng club.

Sa termino ni Yap, pinalawig pa ang kasunduan naturang MOA: Napagkasunduan na walang miyembro ng media na nahaharap sa Libel ang maaring arestuhin kapag araw ng Biyernes hanggang Linggo at holidays. Ito’y upang magkaroon ng pagkakataon ang akusado na makakuha ang abogado, makapaglagak ng piyansa para hindi madetine at patuloy na magampanan ang trabaho bilang mamamahayag.

‘Yan, mga arresting officer, siguro naman ay maliwanag na sa inyo kung paano ninyo ihahain ang warrants of arrest sa mga miyembro ng media na may kaso ng Libel.

Tinalakay ko ang isyung ito dahil sa pag-aresto sa aming kasamahang si Jerry Yap, dating presidente ng NPC at publisher pa ng HATAW, nitong nakalipas na Linggo (Easter Sunday) sa NAIA Terminal 3 kasama ang kanyang mga anak galing sa bakasyon sa Japan.

Ang nag-aresto sa kanya ay mga miyembro ng Manila Police District. Ang nagdemanda sa kanya ng Libel ay hepe ng intelligence ng MPD.

Anyway, nitong Biyernes, nagsampa ng kaso sa Office of the Ombudsman si Yap laban sa mga pulis na umaresto sa kanya.

Tingnan natin kung ano ang magiging desisyon rito ng Ombudsman.
