HB 521 PAG-ASA NG CONTRACTUAL EMPLOYEES

BINIGYANG pag-asa ni Kabayan partylist Rep. Ron Salo ang mahigit 660,000 contractual at job order employees sa gobyerno na magiging regular sa kanilang trabaho kahit wala silang civil service eligibility.

Sa pagbubukas ng 19th Congress, ihinain ni Salo ang House Bill (HB) 521 o ang Automatic Civil Service Eligibility Act na magiging tulay tungong regularisasyon ng mga contractual at casual employees na matagal nang nagsisilbi sa gobyerno.

Sa record ng Civil Service Commission (CSC) noong 2017, mahigit 2.4 milyong empleyado ng gobyerno na kinabibilangan ng 1.5 milyong career service personnel, 200,000 non-career service personnel at mahigit 660,000 contractual o casual workers.

“Ang pangunahing dahilan kung bakit hindi mabigyan ng full entitlement ang mga contractual, casual o job order employees ay dahil wala silang eligibility para maging kalipikado at maregular sa kanilang trabaho.”

Sa kasalukuyan, ang tanging basehan ng pagbibigay ng eligibility ay sa pamamagitan ng eksaminasyon, at hindi nabibigyan ng konsiderasyon ang kanilang karanasan gaano man sila katagal sa serbisyo sa gobyerno,” ani Salo.

Dahil diyan, kahit ilang taon at dekada nang nagtatrabaho ang mga empleyado sa gobyerno ay hindi maibigay sa kanila ang karapatang magkaroon ng security of tenure.

Upang matulungan sila, nais ni Salo na maipasa ang kanyang panukala upang lahat ng mga contractual, casual o job order employees ay awtomatikong mabibigyan ng civil service eligibility kapag nagtagal sila sa kanilang trabaho nang tatlong taon.

Nakasaad din sa panukala na kahit naputol ang serbisyo ngunit nakapagserbisyo ng kabuuang limang taon ang isang contractual, casual, o job order employees ay pagkakalooban pa rin ng Civil Service Eligibity.

“If the employee in the government has been continuously rehired or have their contract renewed consecutively for a period of three (3) years or more, or been re-hired for at least five (5) years even if not continuous, it can be presumed that the employee has been performing functions that are necessary and desirable in furtherance of the government’s mandate,” paliwanag ni Salo kung bakit dapat bigyan ng pagkakataon na maging regular kahit hindi sila nakapasa sa civil service eligibility examanination.

Kailangan din maging ehemplo ang gobyerno sa private sector lalo na’t itinutulak ng estado na tapusin ang “Endo” o 5-5-5 scheme at sumunod sa Labor Code na sa loob ng anim na buwan ng employment ay dapat maregular ang kanilang mga empleyado.

“The 1987 Philippine Constitution explicitly provides that the State must endeavor to protect the security of tenure of each employee, which provision applies to both in the public and the private sectors. It is imperative upon Congress to craft the necessary legislation in order to protect this constitutional right,” anang kongresista. (GERRY BALDO)
