Kartel sa power industry pigilan  
AMYENDA SA EPIRA IPASA NANG MABILIS – SOLONS

NANAWAGAN ang dalawang mambabatas  na pangunahing may-akda ng panukalang batas bilang amyenda sa Electric Power Industry Reform Act (EPIRA) na agarang ipasa ito upang mapigilan ang conflict of interest o kartel sa power industry.

Tahasang tinukoy ni Rep. Caroline Tanchay, ang EPIRA ay nagpapahintulot sa tinatawag na cross-ownership sa hanay ng mga players sa power industry na nauuwi sa pang-aabuso.

Si Tanchay ay co-authored ng House Bill No. 174 — Act Prohibiting Cross Ownership Among Distribution Utilities and Generation Companies — kasama si Rep. Rodante Marcoleta na parehong kabilang sa SAGIP Party-list.

Nilalayon ng naturang panukala na amiyendahan ang Section 45 ng EPIRA Law na nagpapahintulot ng cross-ownership sa distribution at generation facilities sa power sector.

Sa naturang probisyon ay pinapayagan ang distribution utilities na kumuha ng maximum na 50 porsiyento ng kanilang electric supply mula sa kanilang “associated firm.”

“Simply put, if both the distribution utility and the generation company are controlled by one entity, they are to be considered as associated firms,” paliwanag sa HB 174.

Ngunit sa implementing rules and regulations (IRR) ng EPIRA, mas pinalawig nito ang kahulugan ng associated firms na pinapayagan ang “private power firms na mag-circumvent ang umiiral na generous cross-ownership limitation sa EPIRA.”

“The approval of this measure is earnestly sought,” paliwanag nina Tanchay at  Marcoleta na nakapaloob sa panukalang batas.

Inihalimbawa rin sa panukala ang kaso ng Manila Electric Company (Meralco) na tila may pagkontrol sa distribution ng koryente sa Metro Manila at iba pang mga kalapit na probinsiya na kumakatawan sa 75 porsiyentong kabuuan ng ating ekonomiya.

Tinukoy sa panukala, ang Meralco ay bahagi rin ng kompanyang Powergen Corporation (MGen) na mayroong “shares” ng pagmamay-ari sa power generating plants ng mga sumusunod: ang 455-megawatt San Buenaventura Power Plant sa Mauban, Quezon; ang  237-megawatt coal-fired plant sa Sarangani;  at ang 120-megawatt plant sa Zamboanga.

Bukod sa pagmamay-ari ng Meralco sa mga nabanggit ay pumasok din sila sa isang joint venture agreement sa San Miguel Corp., para sa 1,200-MW coal plant sa Mariveles, Bataan.

“Totaling the amount of the contracted power vis-à-vis the demand of Meralco would translate to almost 95% of the demand of Meralco, as part of the MVP Group, sourced from associated firms,” saad sa nilalaman ng HB 174.

Kamakailan, nabili ng Meralco ang majority ownership ng Ilijan Power Plant mula sa SMC’s South Premiere Power Corp., at sa huli ay ipinagkaloob ang PSA sa SPPC na magsu-supply ng 1,200 MW sa Meralco.

Pansamantalang ipinagpaliban ang $3.3 billion deal ng Meralco Power Gen, San Miguel Global Power Holdings, at Aboitiz Power upang ilunsad ang kauna-unahan at most expansive LNG terminal sa Batangas.

Sa sandaling tuluyan nang umandar ang operasyon ng LNG facility sa Batangas ay inaasahan na magsu-supply ito ng fuel para sa planta na inaasahang mag-generate ng mahigit sa 2,500 MW ng koryente.

“However, the abhorrent contravention of the EPIRA, through its IRR, allows Meralco to cartelize the power industry, to the prejudice and damage of its consumers. These apparent conflict-of-interest situations were on top of deals freely available to Meralco in contracting power supply from its affiliates which is allowed generously by EPIRA,” pahayag ng dalawang mambabatas.

“This bill seeks to avoid this monopoly altogether by eliminating the allowance for cross-ownership in EPIRA and by adjusting its IRR accordingly,” diin sa HB 174.

“The prohibition on any form of cross-ownership will remove the conflict of interest among distribution utilities and generation companies, allowing a level playing field for all stakeholders,” giit ng mga mambabatas. (NIÑO ACLAN)
