“Sufficient in substance” idineklara sa 2 impeachment complaint vs Sara

IDINEKLARA ng House Committee on Justice na ang natitirang dalawang impeachment complaint laban kay Bise Presidente Sara Duterte ay supisyente sa sustansiya sa botong 54 laban sa isang boto ni Cong. Jesus “Bong” Suntay ng Quezon City.

Sa pagdinig ng komite, na pinamumunuan ni Batangas Rep. Gerville Luistro, hiwalay na pinagbotohan ang reklamo na inihain ng grupo ni Fr. Joel Saballa, na inendoso ni Mamamayang Liberal party-list Rep. Leila de Lima, at ni Atty. Nathaniel Cabrera, na inendoso nina Manila Rep. Bienvenido Abante, Jr. at La Union Rep. Paolo Ortega V.

Pareho ang naging resulta ng botohan: 54-1 at walang abstention.

Noong Martes tinalakay ang Saballa complaint at ngayong Miyerkoles naman ang Cabrera complaint.

Kasunod ng pagdedeklara na “sufficient in substance” ang mga reklamo, naghain ng mosyon si San Juan City Rep. Ysabel Maria Zamora upang magpadala ng notice kay Duterte para pasagutin ito sa mga alegasyon sa loob ng 10 araw.

Ayon kay Luistro ang sagot ni Duterte ay ipadadala sa mga complainant na bibigyan naman ng tatlong araw para magsumite ng reply.

“We will be welcoming also the submission of evidence that is because both complaints were declared sufficient in substance already. If there are affidavits and counter-affidavits we should be notified by the complainants because they need to be sworn in before the Justice committee,” ayon kay Luistro.

Matapos na matanggap ang mga dokumento at ebidensiya, sinabi ni Luistro na tutukuyin ng komite kung mayroong sapat na batayan ang mga alegasyon.

“And if the decision of the committee is in the affirmative, that’s the only time that we will be proceeding to the hearing proper,” ani Luistro.

Ang huling bahagi ng pagdinig ng komite ay ang botohan kung mayroong probable cause o wala.

Anuman ang maging desisyon ng komite ito ay pagbobotohan sa plenaryo. Kung aabot sa one-third o 106 ng kabuuang 316 miyembro ng Kamara ang papabor sa impeachment, ito ay ipadadala sa Senado para sa impeachment trial.

“Once all evidence and responsive pleadings are completely gathered, the committee will then determine whether there is sufficient ground to support the impeachment complaints,” paliwanag ni Luistro

“Only if the committee’s decision is affirmative will the process move to the formal hearing stage,” aniya.
