Pichay ipinadidiskalipika sa Comelec bilang Surigao cong’l bet

IPINAKAKANSELA sa Commission on Elections (Comelec) ang muling pagtakbo ni Surigao Del Sur 1st District Rep. Prospero Pichay, Jr., dahil sa kawalan umano ng kalipikasyon para humawak ng posisyon sa public office.

Sa petisyon ni Construction Worker’s Solidarity (CWS) partylist Representative Romeo Momo, iginiit na dapat kanselahin ang certificate of candidacy (COC) ni Pichay.

Aniya, wala nang karapatan si Pichay na humawak ng anomang posisyon sa pamahalaan dahil pinagtibay ng Court of Appeals noong 2013 ang desisyon ng Ombudsman na guilty si Pichay para sa grave misconduct, may kaparusahang “dismissal from the government service” at may kasamang “perpetual disqualification to hold public office” o habambuhay na diskalipikasyon sa paghawak ng anomang public office.

Batay sa petisyon ni Momo, sinadya ni Pichay na ideklarang eligible siya sa pagtakbo para sa public office at sumagot ng “no” para sa tanong na “have you ever been found liable for an offense which carries with it the accessory penalty of perpetual disqualification to hold public office, which has become final and executory?”

“Fully aware of the concurrence of respondent Pichay, Jr.’s false representation pertaining to a material matter which refers to his qualifications for elective office, of his deliberate attempt to mislead, misinform, or hide a fact which would otherwise render him eligible and of his intention to deceive the electorate as to his qualifications for public office,” ayon sa petisyon na inihain ni Momo.

Ibinasura rin ng Ombudsman ang mosyon ni Pichay na baliktarin nito ang ipinataw sa kanyang guilty verdict sa kaso. Wala umanong nakitang rason ang Ombudsman para pagbigyan ang “motion for reconsideration” ng mambabatas.

Sa petisyon ni Momo, iginiit niyang i-disqualify ang pagtakbo ni Pichay sa eleksiyon 2022 batay sa dokumentong nagkokompirmang kasama si Pichay sa umano’y listahan ng “perpetually disqualified” na maupo sa public office o muling magserbisyo sa gobyerno.

“That subsequently, the Honorable Commission issued COMELEC Document No. 17-0108 (LAW 16-04243) confirming that in its 09 December 2015 letter to Atty. Wendell Ian C. Perez, Graft Investigation and Prosecution Officer II, that the name of respondent Pichay, Jr., among others, was entered in the database/list of those who are perpetually disqualified to hold public office/reemployment in the government service for purposes of subsequent elections,” paglalahad nito.

Matatandaan, hinatulang guilty si Pichay, dating chairman ng Local Water Utilities Administration (LWUA), at dalawa pang tauhan nito sa anomalya na paglalabas ng P780 milyong pera ng LWUA para bumili ng 60% share ng isang local thrift bank – ang Express Savings Bank Inc., noong 2009.

Itinuloy ni Pichay ang pagbili ng naluluging banko kahit tutol dito ang Department of Finance at pati na ang Office of the Solicitor General.

Base sa Ombudsman rules at sa mga desisyon ng Supreme Court, ang desisyon ng Ombudsman ay immediately executory even pending appeal kaya dapat ay ipatupad ng COMELEC as a constitutional body ang desisyon ng Ombudsman na hindi na maaaring humawak ng posisyon sa gobyerno si Pichay.
