SUPORTADO ni Senate Minority Leader Franklin Drilon si vaccine czar Secretary Carlito Galvez, Jr., sa desisyong ‘wag bigyan ang vaccine manufacturer/s ng blanket immunity sa bawat bakuna ukol sa CoVid -19.
Ayon kay Drilon, sapat nang hindi sila maaaring sampahan ng kaso ngunit sa iba pang pananagutan ay hindi ligtas ang vaccine manufacturers.
Binigyang-diin ni Drilon, taliwas sa ating Konstitusyon at umiiral na polisiya ang nais ng vaccine manufacturers.
“The government cannot grant absolute and blanket immunity to vaccine manufacturers, saying ‘it is against the law and contrary to public policy,’” ani Drilon.
Magugunitang ibinunyag ni Galvez na mayroong vaccine manufacturers ang nagde-demand ng full immunity na taliwas sa itinatakda ng ating batas.
Iginiit ni Drilon, sa sandaling akuin ng pamahalaan ang lahat ng pananagutan ay maaaring sampahan ng kasong malpractices at willful misconduct sa sandaling magkaroon ng severe adverse effect ang isang taong nabakunahan na.
“Under the CoVid-19 Vaccination Program Act Congress passed last February 22, CoVid-19 vaccine manufacturers are immune from suits for claims arising out of the administration of the CoVid-19 vaccine, but not for willful misconduct or gross negligence,” pagtitiyak ni Drilon.
Sinabi ni Drilon, maaaring maghain o magsama ng claims for damages sa manufacturers liabilities mula sa willful misconduct at gross negligence.
Ito aniya ay karapatan ng bawat isang mamamayan na hindi maaaring isantabi o balewalain ng pamahalaan o estado.
“The Supreme Court has defined gross negligence as negligence characterized by the want of even slight care, or by acting or omitting to act in a situation where there is a duty to act, not inadvertently but willfully and intentionally, with a conscious indifference to the consequences, insofar as other persons may be affected.
“Willful misconduct, on the other hand, exists where the acts were impelled by an intention to violate the law, or were in persistent disregard of one’s rights, as evidenced by a flagrantly or shamefully wrong or improper conduct,” ani Drilon.
Inilinaw ni Drilon, sa batas, kanilang pinagtibay na nakapaloob ang pagkakaroon ng “indemnity fund” na sasagutin ng pamahalaan kapag nakaranas ng adverse severe effect matapos mabakunahan.
“The government set up the indemnity fund to compensate any person inoculated through the vaccination program. The indemnity fund will take care of the costs for deaths, permanent disabilities and hospital confinements caused by vaccination,” ani Drilon.
