Petisyon vs BBL inihain sa SC

ISANG petisyon ang inihain ng iba’t ibang grupo sa Supreme Court (SC) upang ipabasura ang Comprehensive Agreement on Bangsamoro (CAB) na siyang pundasyon ng isinusulong na Bangsamoro Basic Law (BBL).

Ang naturang apela ay isinumite ng Philippine Constitution Association, Tacloban Rep. Ferdinand Martin Romualdez, dating Senador Francisco Tatad, dating Defense Secretary Norberto Gonzales at mga arsobispong sina Ramon Arguelles, Fernando Capalla at Romulo Dela Cruz .

Sa 24-petisyon ng grupo, iginiit nilang may nalabag ang pamahalaan nang pumasok ito sa usapang pangkapayapaan kasama ang Moro Islamic Liberation Front (MILF).

Diin ng lead legal counsel ng grupo na si dating SC Justice Manuel Lazaro, “The provisions of the FAB (Framework Agreement on the Bangsamoro) and the CAB are against the provisions of the Constitution. So, the FAB and The CAB, we believe are unconstitutional, ‘yung dalawa.

“So if the FAB and the CAB are unconstitutional, anything that arises therefrom must also be unconstitutional. We are not against the BBL… but it must be drafted according to the Constitution.

Iginiit ni Lazaro na hindi basta pwedeng palitan ng isang kasunduan ang itinatag na Autonomous Region in Muslim Mindanao (ARMM).

Layon ng petisyon nina Lazaro na maglabas ang Korte Suprema ng temporary restraining order (TRO) at writ for prelimanary injunction para ideklarang unconstituional ang FAB na nilagdaan noong 2012 at ang CAB na pinirmahan noong Marso.
