Pagbabawal sa substitution ng kandidato isinulong

INIHAIN ni Deputy Speaker at Cagayan de Oro City Rep. Rufus Rodriguez ang dalawang panukalang naglalayong ipagbawal ang pagpapalit ng mga kandidato pagkatapos maisumite ang certificates of candidacy (COC).

Kasama rin sa inihain ni Rodriguez ang panukalang ideklara ang isang nakaupong opisyal bilang nagbitiw sa tungkulin matapos magsumite ng COC para sa isang posisyon.

“These twin measures aim to put an end to practices by politicians and political parties that tend to put in doubt the integrity of our elections,” ani Rodriguez.

Nakasaad sa panukala bilang 10380, ang isang partido politikal ay hindi maaaring magpalit ng kandidato maliban kung ito’y namatay o madiskalipika.

Paliwanag ni Rodriguez, ang Omnibus Election Code ay pumapayag sa substitution kung ang kandidato ay namatay, diskalipikado, o may umatras na isang aspirante.

“While there is nothing wrong with substitution in case of death or disqualification which is justifiable, substitution because of withdrawal, or what others call voluntary substitution, may pose serious questions and may lead to the manipulation and mockery of the election process,” aniya.

“Withdrawals could lead the voting public to believe that the candidate who withdrew, or even the political party or substituting candidate, is not really serious,” anang kongresista ng Cagayan de Oro.

Aniya sa ilalim ng batas pinahihintulutan ang Commission on Elections (Comelec) na i-disqualify ang isang aspirante kung ilalagay nito ang eleksiyon sa katatawanan.

“As such, any person who has no real intention to run and only filed for candidacy as a place holder (for another aspirant) should be declared as a nuisance candidate,” aniya.

Ang pagbawal sa substitution ay magbibigay sa Comelec ng sapat na panahon para saliksikin ang mga naghain ng COC upang makapaghanda sa paglabas ng pinal na listahan ng mga kandidato at makagawa ng balota at iba pang mga kailangan sa eleksiyon.

Sa House Bill 10381, hinimok ni Rodriguez ang kapwa kongresista na ibalik ang probisyon sa Fair Election Act of 2001 na naglalayong ideklara ang sinomang opisyal bilang nagbitiw sa puwesto sa panahon na siya’y nag-file ng COC.

“It is high time to reinstate the repealed provision on elective officials being deemed resigned once they file their certificates of candidacy, but only if they file for another position different from the ones they are currently holding,” ani Rodriguez.

“This would force aspirants to take running for higher office seriously and to stop manipulating and mocking the electoral process. It would also make more people believe in the integrity of our elections,” dagdag niya. (GERRY BALDO)
