Lipat ng pondo ng DOH sa DBM, labag sa konsti (‘Bata ni Go’ sinupalpal)

LABAG sa Saligang Batas ang paglipat ng mahigit P42 bilyong CoVid-19 funds ng Department of Health  (DOH) sa Department of Budget and Management (DBM).

Inihayag ito ni dating DBM Secretary at dating Camarines Sur. Rep. Rolando Andaya, Jr., sa panayam sa ANC kaugnay sa nabistong P42-B ibinigay ng DOH sa DBM para ipambili ng facemask at face shields na sinasabing overpriced ng isang bilyong piso.

Ang paglipat aniya ng P42-B ng DOH sa DBM nang walang memorandum of agreement (MOA) ay ‘unconstitutional.’

“What Usec Lao said about not needing a memorandum of agree­ment between the Department of Budget and Management and Department of Health is not true. That’s unconstitutional. An entire provision in the 1987 Constitution was dedicated to prevent the very same act,” diin ni Andaya.

“The Constitution states that no law shall be passed authorizing any transfer of appropriations, however, the President, the President of the Senate, the Speaker of the House of Representatives, the Chief Justice of the Supreme Court, and the heads of Constitutional Commission may, by law, be authorized to augment any item in the general appropriations law for their respective offices from savings in other items of their respective appropriations.”

Noon pa, aniyang 2018 ay pinuna na ng Commission on Audit (COA) ang kostumbre ng paglilipat ng pondo sa DBM at bilang mambabatas noon ay ipinursigi niya ang isang imbestigasyon ngunit binalewala ni noo ‘y Budget Secretary Benjamin Diokno.

“I did the investigation myself but the secretaries snubbed the investigation. Remember, (then DBM Secretary Benjamin) Diokno refused to appear sa committee. He actually fired the Procurement Service head back then for attending the hearing,” ani Andaya.

Si Diokno aniya ang pasimuno ng pagkarga ng DBM sa pagsasagawa ng mga proyekto ng ibang kagawaran.

Nauna rito’y iginiit ni dating PS-DBM chief Lloyd Christopher Lao na hindi na kailangan ng MOA sa pagitan ng DOH at DBM dahil ang mga binili ay ‘common items’ na ginagamit sa pagtugon sa pandemya at mataas ang presyo nito noong simulang manalasa ang CoVid-19 noong 2020.

Batay sa 202o COA report, ang binili ng PS-DBM na facemask ay may presyong P27 isa habang ang face shield ay P120 isa.

Bago napunta sa PS-DBM, nagsilbi si Lao bilang Undersecretary sa Presidential Management Staff-Office of the Special Assistant to the President nang si Sen. Christopher “Bong” Go ay Special Assistant to the President.

Sa Senate Blue Ribbon Committee ay sinabi ni Sen. Richard Gordon na ang Philippine Red Cros ay nakabili ng facemask sa halagang P5 sa panahong binili ito ng DBM sa P27.

Kahit wala pang resulta ang mga imbesti­gasyon sa isyu ng paggasta ng DOH sa CoVid-19 funds ay inabsuwelto muli ni Pangulong Rodrigo Duter­te sa kabila ng pana­wagan na sibakin siya o magbitiw sa puwesto.
