ABSUWELTO si Tony Labrusca sa kasong slight physical injuries na inihain ng nangangalang Dennis Ibay, Jr sa Makati Prosecutor’s office noong Hunyo 4, 2021.
Sa resolusyong inilabas noong Hunyo 12, 2021 ni Makati Senior Assistant City Prosecutor Edmund Seña, napawalang-sala ang Kapamilya actor “on technical grounds.”
Ayon kay Senior Assistant City Prosecutor Sena, ”This resolves the complaint for slight physical injuries filed by Dennis F. Ibay Jr. against Anthony Angel Jones Labrusca Jr., a.k.a. ‘Tony Labrusca.’
“Record shows that the incident subject matter of the case happened on January 16, 2021.
“However, the complaint was only filed before this Office on June 04, 2021, or after more than two months from the time of the incident.
“Considering that the complaint for slight physical injuries against respondent was only filed on June 04, 2021, or after more than two months from the date of its alleged commission, the crime is already extinguished by reason of prescription.
“Wherefore, premises considered, it is respectfully recommended that the complaint for slight physical injuries against Anthony Angel Jones Labrusca, Jr., a.k.a. ‘Tony Labrusca’ be dismissed on the ground of prescription.”
Natanggap na rin ni Atty. Joji V. Alonso, legal counsel ni Tony ang kopya ng resolusyon mula sa Makati City Prosecutor’s Office.
Ayon kay Atty. Joji, ”While the decision of the Honorable Office was based on technical grounds, we remain steadfast that our client is innocent from the aforesaid charge.”
Sa kasalukuyan, hinihintay pa ang resolusyon ng Makati Prosecutor’s Office sa two counts of aggravated acts of lasciviousness case na isinampa naman ng babaeng kasama ni Ibay.
Nasabi na ni Atty. Joji na ”mere allegations” at ”unfounded claims” ang mga kasong isinampa kay Tony.
“We call the public to be mindful of casting judgment based on mere allegations and unfounded claims.
“We welcome the legal process taking its course, where in the end, the truth shall always prevail. We look forward to clearing @tony.labrusca’s name.”
