Palasyo aminado sa US participation sa Oplan Exodus

PNOY SAF 44AMINADO ang Palasyo na may partisipasyon ang Estados Unidos sa Oplan Exodus o operasyon laban kay international terrorist Zulkifli Bin hir alyas Marwan.

Sinabi ni Communicastions Secretary Herminio Coloma Jr., ang krimen na kinasasangkutan ni Marwan ay isang transnational crime at ang paglaban dito’y pinagtutulungan ng iba’t ibang bansa, gaya ng US at Filipinas.

“Hinanap si Marwan, Marwan is an international — is a suspect in terrorism, which is considered a transnational crime. By definition,  kapag transnational crime it involves more than one nation, it involves crossing of boundaries and it involves sharing of information among countries na mayroong relevant information,” ani Coloma.

Ngunit dahil ipinagbabawal ng Konstitusyon ang pakikialam ng dayuhan sa mga operasyon ng awtoridad sa bansa, dapat alamin aniya sa mga isinasagawang imbestigasyon kung may direktang partipasyon ang mga tropang Amerikano sa Oplan Exodus.

“Pero sa aspeto ng pagsasagawa ng  mga operasyon ay malinaw din naman ang ating mga batas na hindi dapat na mayroong foreign participation at foreign intervention. Kaya dapat lang ay malaman ito sa mga kasalukuyang pagsisiyasat,”  ani Coloma.

“Under Article XVIII Section 25 of the Constitution, no foreign troops are allowed in PH except under a treaty. That is the governing principle,” giit ni Coloma.

Wala naman nakasaad aniya sa Mutual Defense Treaty (MDT) at Visiting Forces Agreement (VFA) na pinahihintulutan ang paglahok ng tropang Amerikano sa law enforcement operation sa bansa.

“MDT concerns actions to defend PH from foreign aggressor. VFA covers training and joint military exercises,” dagdag pa ni Coloma.

Sa artikulong inilathala sa May-June 2004 issue ng US Army Combined Arms Center, Military Review, sinabi ng first commander ng Joint Special Operations Task force Philippines (JSOTFP) na si Col. David Maxwell, ang pag-estasyon lang ng dayuhang tropa sa Filipinas ang ipinagbabawal ng Philippine Constitution at hindi ang combat operations.

Tinukoy ni Maxwell sa artikulo ang Mutual Defense Treaty na nilagdaan ng Amerika at Filipinas noong Agosto 30, 1951.
