Int’l women’s group naalarma sa trato vs Andrea Rosal

NAGPAHAYAG ng pagkaalarma si International Women’s Alliance Chairperson Liza L. Maza kaugnay sa pag-aresto sa siyam-buwan buntis na si Andrea Rosal nitong Marso 27 at sa ulat na pagkakait sa kanya ng access sa legal advice ilang oras makaraan siyang maaresto, na paglabag sa kanyang karapatan sa legal counsel at sa “UN Rules for the Treatment of Women Prisoners and Non-Custodial Measures for Women Offenders” o kilala bilang Bangkok Rules.

Bukod dito, pinagkalooban lamang si Rosal ng medical attention dalawang araw makaraan siyang maaresto bunsod ng mga protesta.

Ang Bangkok Rules na inaprubahan ng United Nations General Assembly noong 2010 ay nagtatakda ng mga patakaran kaugnay sa pagtrato sa babaeng preso. Dahil ang umiiral na prison facilities sa buong mundo ay idinesenyo para sa mga lalaking preso, binuo ang Bangkok rules bilang konsiderasyon sa mga babaeng preso “who […] are one of the vulnerable groups that have specific needs and requirements.”

“We are concerned that Ms. Rosal’s basic civil right to counsel was denied by Government forces enforcing the arrest warrant,” pahayag ni Maza.

Nanawagan siyang pagtuunan ng pansin ang rule 2 paragraph 1 ng Bangkok Rules, nakasaad na, “Adequate attention shall be paid to the admission procedures for women and children, due to their particular vulnerability at this time. Newly arrived women prisoners shall be provided with facilities to contact their relatives; access to legal advice […]”

Nangamba rin si Maza na maaaring hindi napagkalooban si Rosal ng sapat na medical attention lalo’t malapit na siyang manganak, na malinaw na paglabag sa rule 23 paragraph 1 ng “Standard Minimum Rules for the Treatment of Prisoners,” nakasaad na, “In women’s institutions there shall be special accommodation for all necessary pre-natal and post-natal care and treatment. Arrangements shall be made wherever practicable for children to be born in a hospital outside the institution.”

Ipinunto rin ni Maza ang rule 64, nakasaad na, “Non-custodial sentences for pregnant women and women with dependent children shall be preferred where possible and appropriate, […].”

Dagdag ni Maza, bunsod ng maselang kondisyon ni Rosal, maaari siyang mapalaya “on recognizance” o palayain nang walang kondisyon dahil sa kwestyonableng dahilan sa kanyang pagkaaresto.
