COVID-19 protection law isinulong

ISINULONG ni Cavite Rep. Elpidio Barzaga ang pagkakaroon ng batas para maprotektahan ang mga tao na nagpabakuna ng CoVid–19.

Ani Barzaga ang batas ay para sa proteksiyon ng mga nabakuhan laban sa mga ayaw magpabakuna.

Aniya, nakasaad sa General Welfare clause na ang Estado ay inaatasang gumawa ng panuntunan at mga regulasyon upang maprotektahan ang buhay ng karamihan.

“A person who is not vaccinated is a risk to the lives of others and to the general community,” ani Barzaga.

“The State can therefore enact a general law protecting those who are vaccinated from those who are not vaccinated.  While others might argue that such law shall be discriminatory – discriminating those vaccinated against those non-vaccinated –  nonetheless there shall be no violation of the constitutional rights to due process and equal protection clause.  Every individual therefore to avoid adverse consequences must allow themselves to be vaccinated,” paliwanag niya.

Sa pagsisiyasat ng University of the Philippines-OCTA research team noong Pebrero, ipinakita nito na 19 porsiyento ang gustong magpabakuna, 46 porsiyento ay ayaw, at 35 porsiyento ay hindi pa nakapagpasya.

Paliwanag ni Barzaga hindi magiging sapat ang proteksiyon sa bansa kung iilan lamanng ang magpapabakuna.

Ayon sa mambabatas, “while the Constitution guarantees the right to life of every individual, such right is subservient to the paramount interest of the lives of the greater majority.”

Ayon kay Barzaga sinabi sa Article II, Section 5 of the Constitution (Declaration of Principles and State Policies): “The maintenance of peace and order, the protection of life, liberty, and property, and the promotion of the general welfare are essential for the enjoyment by all the people of the blessings of democracy.”

Aniya sinasabi ng Saligang Batas na magiging legal ang pagtaboy ng mga employer sa mga taong walang bakuna.

Maaari rin, aniya, na tumanging magpapasok ang mga malls, hotel, at restaurants sa mga taong hindi pa nabakunahan.

Maari rin itong gawin ng mga pribadong parke at mga eskwelahan na maaring gawing kondisyon sa enrolment ang pagbakuna.

“Even the right to travel shall be restricted,” ani Barzaga. (GERRY BALDO)
