Kamara vs dambuhalang online store
‘UNFAIR LABOR PRACTICES’ NG SHOPEE BUSISIIN — SOLON        

NAGLUNSAD ng imbestigasyon ang Kamara de Representantes laban sa reklamong pagsasamantala ng Shopee sa kanilang delivery drivers.

Ayon kay Party-List Rep. Lex Colada ng Asosasyon Sang Mangunguma Nga Bisaya-Owa Mangunguma (AAMBIS-Owa), napapanahon nang imbestigahan ang Shopee sa malalang unfair labor practices ng dambuhalang online store na nakabase sa Singapore.

Nanawagan si Colada sa mga kapwa kongresista na silipin ang pananabotahe sa tangkang pagtatayo ng unyon ang kanilang truck drivers.

Nais ng kongresista na humarap si Jan Frederic Chiong, ang chairman ng Shopee Philippines na siya rin may hawak sa SPX Express Philippines na mas kilala sa pangalang  Shopee Express, sa Kamara upang sagutin ang mga alegasyon laban sa kanyang kompanya.

“Shopee has managed to skirt the labor issue by citing the non-existence of a direct employer-employee relationship with its pool of truck drivers. But this is unfair to the hundreds of drivers who bear the heat of the sun to transport the bulk of goods purchased on the Shopee platform,” ani Colada.

         Halos 257 drivers na nakabase sa bodega ng Shopee sa ParColada ang naghain ng “direct certification election” para makapagtayo ng unyon.

Nais ng mga driver na magkaroon ng sapat na sahod at trabaho sa tamang oras. Hindi sila regular na empleyado ng kompanya.

         Batay sa pamamahala ng Shopee, hindi maaaring magtayo ng unyon ang mga driver dahil hindi sila direktang empleyado ng kompanya.

Ang mga driver ay sinabing empleyado ng 22 subcontractors nila sa buong bansa.

         Giit ng mga driver, ang mga truck na ginagamit nila ay pag-aari mismo ng SPX at ito ay kontrolado rin ng pamamahala ng Shopee.

         “These are enough pieces of evidence that Shopee and SPX need to take care of the petitioner-truck drivers, and should allow them to unionize,” paliwanag ni Colado.

         Ayon sa kongresista, nauna nang kinatigan ni mediator-arbiter Atty. John Malinao ang petisyon ng mga driver ngunit binawi ito kasunod ng “motion for reconsideration” ng Shopee.

Kinatigan ng Department of Labor and Employment (DOLE) ang desisyon ni Malinao kaya’t dumulog na ang mga driver sa Court of Appeals.

“It should be Shopee that must be up to the task of promoting the truck workers’ welfare and respecting their right to form a union, under our country’s labor laws. Not even a foreign firm can evade this responsibility,” dagdag ng kongresista. (GERRY BALDO)
