IPINAAARESTO ni Pangulong Rodrigo Duterte sa mga kapitan ng barangay o pulis ang mga taong hindi bakunado kontra CoVid-19 kapag lumabas ng bahay.

“So barangay captains, you are put on notice and the order for you to find out the persons who are not compliant with the laws or of their refusal to have the vaccines, you can actually prevent them from leaving the house. And if they refuse, because they are persons in authority, you can just insist and arrest him,” sabi niya sa kanyang Talk to the People kamakalawa ng gabi.

“Kung may pulis, pulis na lang ang utusan ninyo. Pero ‘’pag walang pulis, as a person in authority, you can now use reasonable force for him not to continue with his ‘jaywalking’ sa daan kasi you are — you pose a danger in the — to the society,” dagdag niya.

Puwede aniyang paluin ng batuta ng pulis sa paa kapag nanlaban ang hindi bakunadong arestado sa labas ng bahay.

Nauna nang nagpasa ng ‘resolution’ ang Metro Manila Council  na ipinagbabawal sa public areas ang mga hindi bakunadong indibidwal kaugnay sa pagsasailalim sa Alert Level 3 sa National Capital Region mula 3-15 Enero dulot ng muling pagtaas ng CoVid-19 cases.

Para kay Justice Secretary Menardo Guevarra, kailangan magpasa ng ordinansa ang isang lungsod o munisipalidad para maipatupad ang paglilimita sa kilos ng mga hindi bakunadong indibidwal.

“The LGUs comprising the Metro Manila Council must enact their respective ordinance further restricting the mobility of unvaccinated persons. The MMDA resolution by itself is not legally effective,” ani Guevarra.

Aniya, alinsunod sa Local Government Code, may police power ang local legislative councils.

“This delegated police power authorizes them to pass such ordinances as they shall deem to be for the welfare of their constituents,” aniya.

Ang anomang kuwestiyon sa legalidad nang paghihigpit ay korte ang magpapasya.

“This is a matter for the courts to determine. Unless judicially restrained, however, these public health measures may actually be executed and enforced,” giit ni Guevarra.

Kaugnay nito, ilang bus terminal sa Metro Manila ang nagpatupad ng no vaccine, no ride policy.

Kapag walang maipakitang vaccine card ang pasahero ay hindi pinapayagan sumakay ng bus.

Ayon sa Metro Manila Development Authority (MMDA) kahit kailangan pa na may maipasang ordinansa ang lokal na pamahalaan na nakasasakop sa terminal, hindi naman nila mapipigilan ang mga establisimiyento o kompanya na ipatupad ang sariling patakaran.

Sa ilalim aniya ng Inter-Agency Task Force (IATF) for the Management of Emerging Infectious Diseases pinapapayagan magpatupad ng sariling patakaran ang mga kompanya kaugnay sa unvaccinated individuals.
