Panelo palso sa aresto vs anti-vaxxer — law experts

SABLAY ang pahayag ni Chief Presidential Legal Counsel Salvador Panelo na alinsunod sa Saligang Batas ang pagdakip ng mga awtoridad sa mga taonga yaw magpa­bakuna.

Ayon kay dating Supreme Court spokesman at law professor Theodore Te sa isang tweet, tanging hukom lamang, sa pamamagitan ng isang warrant of arrest,  ang puwedeng mag-utos na arestohin ang isang tao.

Hindi aniya krimen ang hindi pagpapa­bakuna at hindi kasama sa mga insidenteng puwede ang warrantless arrest base sa Revised Rules of Criminal Procedure.

“Rule 113 Section 5(a) holds that a person may be arrested when a crime is committed, is being committed or attempting to commit an offense, Section 5(b) states that a person may be arrested when an offense has just been committed and the officer has probable cause to believe it based on personal knowledge.”

Maging si Integrated Bar of the Philippines (IBP) national president Domingo Egon Cayosa ay pareho ng opinyon nina Justice Secretary Menardo Guevarra at Presidential Spokesman Harry Roque na kailangan ang isang batas na nagpaparusa sa ayaw magpabakuna.

Nagmatigas si Panelo na ang utos ni Pangulong Rodrigo Duterte na arestohin ang ayaw magpabakuna ay may constitutional basis.

Aniya, batay sa “Article II, Section 4 of our Constitution mandates ‘[t]he prime duty of the Government is to serve and protect the people.”

Katuwiran ni Panelo, “Drastic times demand for drastic measures. The Constitution has given sufficient authority to the government to manage the crisis even as it vigorously towards achieving herd immunity while our people look forward to reaching it.”

Matatandaan, ilang beses nang gumamit ng maling argumento si Panelo gaya noong 2020 na aniya’y puwedeng magdeklara ng batas militar si Pangulong Duterte bunsod ng “there is an actual invasion of the coronavirus disease.”

Binigyang katuwiran ni Panelo ang pagtatalaga ng mga sundalo sa Bureau of Customs noong 2018 upang “suppress any and all forms of lawless violence in Mindanao and to prevent such lawless violence from spreading and escalating elsewhere in the Philippines.”

Habang noong 2016 ay sinabi rin niyang puwedeng magdeklara ng martial law si Duterte bunsod ng problema sa illegal drugs sa bansa kahit hindi ito nakasaad sa Saligang Batas bilang basehan ng martial law declaration.

Sa kabila ng ilang salto ni Panelo, tinagurian siyang legal luminary ni Pangulong Duterte.
