MAITATALA sa kasaysayan ng Filipinas si Chief Justice Maria Lourdes Sereno bilang kauna-una-hang impeachable official na mapatatalsik sa puwesto bunsod ng quo warranto petition.
Ito ay kapag pinaboran ng mayorya ng mga mahistrado ng Korte Suprema ang quo warranto petition na inihain ni Solicitor General Jose Calida para ipawalang bisa ang appointment kay Se-reno bilang Chief Justice, sabi ni Presidential Spokesman Harry Roque.
Batay sa petisyon ni Calida, kuwestiyonable ang pagtatalaga kay Sere-no bilang Punong Mahistrado dahil hindi siya nagsumite ng statement of assets, liabilities and net worth (SALN) sa Judicial and Bar Council (JBC), isa sa requirements sa mga kandidato sa puwesto.
“Well, let’s just say, this is unprecedented. While the normal rule is that impeachable officers can only be removed through impeachment, the petitioners who, I believe, are fully cognizant of this doctrine, probably feel that under the circumstance, the general rule should not be applicable,” ayon kay Roque sa press briefing kahapon sa Palasyo.
Hihintayin na lang aniya ng Malacañang ang desisyon ng Korte Suprema sa quo warranto petition ni Calida na nakatakdang dinggin nga-yong umaga.
“So let’s wait for the decision of the Supreme Court,” dagdag ni Roque.
Naniniwala aniya ang Palasyo, ang pananatili ni Sereno sa puwesto ay hindi makabubuti sa Korte Suprema bilang isang ins-titusyon.
“Definitely, that her continued stay in office may not be good for the institution,” aniya.
Ang quo warranto petition ay isang legal proceeding na kinukuwestiyon ang pagkaluklok sa puwesto ng isang opis-yal ng gobyerno.
May kinahaharap din na impeachment case si Sereno sa Kongreso.
