Kulong vs Celdran pinagtibay ng CA

PINAGTIBAY ng Court of Appeals ang parusang pagkakakulong sa tour guide at reproductive health advocate na si Carlos Celdran bunsod nang ginawang pag-iingay sa loob ng Manila Cathedral sa Intramuros, Maynila noong 2010.

Sa 23-pahinang desisyon na isinulat ni Associate Justice Carmelita Salandanan-Manahan ng CA 12th Division, sinasabing hindi nagkamali si Metropolitan Trial Court Branch 4 Judge Juan Bermejo Jr. nang hatulan ng parusa si Celdran dahil sa kasong paglabag sa Article 133, o offending religious feelings.

Si Celdran ay hinatulan ng pagkakulong na dalawang buwan at 21 araw hanggang isang taon at 11 araw dahil sa panggugulo at pagsigaw sa loob ng Manila Cathedral. Nais ni Celdran na tumigil ang Simbahan sa pakikaisali sa usaping kinasasangkutan ng pamahalaan habang hawak ang placard na may nakasulat na “Damaso,” tumutukoy kay “Padre Damaso,” ang kontrabidang pari sa nobela ni Dr. Jose Rizal na Noli Me Tangere.

“The RTC was correct when it found that in conformity with one’s right to free exercise of religion, the faithfuls may, within the limit set by laws, rightfully practice and observe their beliefs, unimpeded by unfair interference from other people… It goes without saying that those people observing certain form of religion or sect are equally entitled to the state’s protection as any of its citizens,” sabi ng appellate court.
