National wealth tax para sa likas na tubig
MOTION FOR RECONSIDERATION INIHAIN SA SC NG BULACAN GOV

NAGHAIN ng Motion for Reconsideration si Bulacan Gov. Daniel Fernando sa Korte Suprema sa naging desisyon nito tungkol sa natural wealth tax para sa likas yaman partikular ang tubig na nanggagaling sa lalawigan, kahapon 11 Abril 2024.

Ang tubig sa mga ilog ng mga watershed ng lalawigan na dumadaloy patungong Angat Dam ang pangunahing pinagkukuhaan ng inumin para sa mga residente ng Kalakhang Maynila.

Sa isinagawang press conference ng gobernador, sinabi niyang, “We mostly humbly and respectfully move for the reconsideration of the decision of the Honorable Court en banc dated 03 October 2023 which ruled that ‘appropriated dam water is not to be considered national wealth, and therefore, not subject to the national wealth tax’.”

Napag-alaman na ang nasabing desisyon ay natanggap ng Provincial Government of Bulacan nitong nakaraang buwan ng Marso taong kasalukuyan.

Binigyang diin ni Fernando, ang patuloy na pakikihamok ay para sa karapatan ng mga Bulakenyo sa biyaya ng tubig ng lalawigan para sa equitable share sa exploration, development, at utilization ng mga  natural resources ng lalawigan base sa Local Government Code of of 1991 o Republic Act 7161.

Sinabi ng gobernadora, base sa 1987 Constitution, bilang likas na yaman ng bansa sa ilalim ng  Article 12, Section 2  nakasaad na:  “All lands of the public domain, waters, minerals, coal, petroleum, and other mineral oils, all forces of potential energy, fisheries, forests or timber, wildlife flora and fauna, and other natural resources are owned by the State.”

Binanggit ni Fernando, kaugnay nito ang Article 386 ng Implementing Rules and Regulations (IRR) ng Local Governments Code patungkol sa “share in the proceeds from the development and utilization of the natural wealth” na maliwanag na nakasaad: “LGUs shall have an equitable share in the proceeds derived from the utilization and development of the national wealth within their respective areas, including sharing the same with the inhabitants by way of direct benefits.”

Matatandaan na naglabas ang Court of Appeals ng desisyon noong 30 Mayo 2008 na kinatigan “with modification” ang desisyon ng  Branch 82 ng Bulacan Regional Trial Court (RTC) na ang parte ng Bulacan mula sa “utilization of the water from Angat Dam must be computed in accordance with section 291 of RA 7160.”

Inatasan nito ang Metropolitan Waterworks Sewerage System (MWSS) na magsumite ng  computations para aprobahan ng trial court sa loob ng limang araw mula sa pagkakatanggap ng order at ipagkaloob ang halaga na nauukol para sa Provincial Treasurer ng Bulacan sa loob ng 10 araw mula nang matanggap ang order ng trial court.

Ngunit ang nasabing desisyon ay nilabanan ng MWSS at ang usapin ay iniakyat sa Korte Suprema. (MICKA BAUTISTA)
