Petisyon laban sa bus ban ihihirit ng Ako Bicol sa SC

MULING hihirit ang Ako Bicol Party-list sa Korte Suprema patung­kol sa pagbabawal ng mga pamprobinsyang bus sa Metro Manila dahil labag ito sa Saligang Batas.

Ayon kay Rep. Alfredo Garbin, kailangan umano, ng agarang aksiyon ng Korte dito dahil apekatado ang lahat ng biyahero maging matanda o bata man.

“The SC should have taken jurisdiction over the petition on the provincial bus ban as in other cases they decided wherein direct resort to SC is allowed when there are  genuine issues of constitu­tionality that must be   addressed at the most immediate time,” ani Garbin.

Aniya, kasama sa mga remedyo na puwe­deng gawin ng Korte ang “certiorari and pro­hibition” upang silipin ang mga aksiyon ng lehislatura at ehekutibo.

“We respectfully submit that the issues of constitutionality raised in the petition as well as the urgency of the need of addressing the same would qualify as exceptionally compelling reasons which would justify direct resort to the Honorable Supreme Court,” ani Garbin matapos ibasura ng Korte ang kanilang petisyon laban sa bus ban ng Metro Manila Development Authority (MMDA).

Giit ng Ako Bicol lumabis ang MMDA sa mandato nito sa paglalabas ng “MMDA regulation No. 19-002 series of 2019.”

Dapat umanong tingnan ng Korte kung ang regulasyon ng MMDA ay dumaan sa “due process,” at kung ito ba ay panghihimasok sa mandato ng Land Transportation Fran­chising and Regulatory Board (LTFRB).
