Warrantless arrest kay Baylosis legal — Palasyo

LEGAL ang warrantless arrest sa 69-anyos National Democratic Front (NDF) consultant Rafael Baylosis, ayon sa Palasyo.

Sinabi ni Presidential Spokesman Harry Roque, wala nang bisa ang safe conduct pass o Joint Agreement on Security Guarantees (JASIG) na hawak ni Baylosis dahil wala nang nagaganap na usapang pangkapayapaan ng pamahalaan at kilusang komunista.

“Wala namang saysay ang JASIG ngayon dahil wala namang peace talks. Bakit sila nagja-JASIG-JASIG ngayon? Pangalawa, anong pagba-violate sa CAHRIL? E inaresto. Ang CAHRIL po, human rights and humanitarian law,” ani Roque.

“E kung may kaso iyong tao, kung may warrant of arrest o ‘di naman kaya may basehan para mag-warrantless arrest, e dapat arestohin talaga dahil kapag hindi naman siya arestohin, it will be deriliction of duty,” dagdag niya.

Hinamon ni Roque ang mga militanteng grupo na maghain ng habeas corpus sa Korte Suprema kung sa tingin nila ay ilegal ang pagdakip kay Baylosis.

“So tingin nila ilegal ang pagkaaresto on the basis of JASIG, e ‘di mag-file sila ng habeas corpus. Wala namang martial law sa Luzon,” sabi ni Roque.

“Pero ang sinasabi ko po, katungkulan ng Presidente na ipatupad ang batas at dahil wala na pong usapang kapayapaan dahil sila rin naman ang may kasalanan diyan, habang nakikipag-usap ng kapayapaan, e patay sila nang patay ng ka[sundalo]han, they are not exempt from full compliance with our penal laws,” giit ni Roque.

Si Baylosis ay sinampahan ng kasong illegal possession of firearms makaraan madakip sa Quezon City, kamakalawa ng hapon.

MARIING kinondena ng grupong Karapatan ang pag-aresto ng mga awtoridad kay National Democratic of the Philippines (NDFP) peace consultant Rafael Baylosis at kanyang kasamang si Guil-lermo Roque, Jr., nitong Miyerkoles.

Ang mga kaanak ni Baylosis ay humingi ng tulong sa Karapatan para hanapin ang NDF consultant makaraan makatanggap ng inisyal na ulat hinggil sa pag-aresto sa kanya.

Dakong 10:00 pm nitong Miyerkoles, nagpadala ang Karapatan ng quick reaction team sa CIDG-NCR office sa Camp Crame, Quezon City, at nakompirmang inaresto at ikinulong sina Baylosis at Guillermo.

Ang dalawa ay kapwa nakapiit sa Crime Investigation and Detection Group (CIDG) – NCR sa loob ng Camp Crame sa Quezon City.

Si Baylosis, miyembro ng NDFP Reciprocal Working Group on Political and Constitutional Reforms, ay 69-anyos na at may dinaramdam na sakit sa puso.

“The government has again focused its efforts in the persecution of peace consultants. Instead of working to resolve the roots of the armed conflict by way of pursuing the peace talks, the Duterte regime has instead resorted to fascist reprisals. We strongly condemn the illegal arrest of peace consultant Rafael Baylosis and Roque Guillermo, as we demand their immediate release,” pahayag ni Karapatan secretary general Cristina Palabay, binigyang-diin na ang pag-aresto ay paglabag sa Joint Agreement on Safety and Immunity Guarantees (JASIG).

Samantala, inilinaw ni Philippine National Police spokesperson Chief Supt. John Bulalacao, ang pag-aresto kay Baylosis ay bunsod ng pag-iingat ng armas at hindi dahil sa utos ni Pangulong Duterte na muling arestohin ang lahat ng NDF consultants.

“Hindi upon the orders of the President, it was only reported to the CIDG that there were people in possession of firearms in that area and so they initiated intelligence operation until they arrested Baylosis and his companion,” aniya.

Sa ipinalabas na pahayag nitong Huwebes, sinabi ng NDFP na kinokondena nila ang pag-aresto at pagkulong kay Baylosis.

“This illegal arrest and detention of NDFP Consultant Rafael Baylosis is a flagrant violation of the GRP-NDFP Joint Agreement on Safety and Immunity Guarantees (JASIG, 1995),” pahayag ni NDFP National Executive Committee member Luis Jalandoni.

Bukod sa paggiit na palayain si Baylosis at kanyang kasama, iginiit din nila kay Pangulong Duterte na igalang at ipatupad ang JASIG, ang Comprehensive Agreement on Respect for Human Rights and International Humanitarian Law (CARHRIHL), at iba pang binding peace agreements.

“President Duterte must not be allowed to kill and destroy the peace negotiations,” ayon kay Jalandoni.
