SINUPALPAL ni Justice Secretary Leila de Lima ang kahilingan ni Bureau of Immigration Commissioner Siegfred B. Mison na mabigyan ng awtoridad sa paghahain ng administratibong kaso at imbestigahan ang mga empleyado ng BI.
Nauna rito, hiniling ni Mison sa kalihim na mabigyan ng exclusive authority “to file or initiate administrative cases against BI employees, conduct preliminary investigation and formal investigation.”
Hiniling din niya na isama ang probisyon na ang final and executory decisions na ipinalabas bago ang DoJ Department Order No. 27 ay ratipikado at kinikilala bilang Operative Facts.
Sinabi ni De Lima, bagama’t maaari niyang pagbigyan ang pangalawang kahilingan, alinsunod sa Department Circular No. 001, hindi niya maaaring pahintulutan na bigyan ang BI ng exclusive authority na maghain o magsampa ng administrative charges laban sa BI employees, at magsagawa ng preliminary investigation at formal investigation.
Bagama’t hindi niya kinukuwestyon ang intensyon sa likod ng kahilingan, sinabi ni De Lima, ang mga probisyon sa DC ay naglalayong ipatupad kung ano ang nakasaad sa batas (The Admin Code of 1987), at ang pagbura sa probisyong nabanggit (primarily Section 2(a), the deletion of which is the basic premise for the deletion of the rest) ay hindi makapagpapabago sa katotohanang ang kalihim ay awtorisado sa ilalim ng batas sa paghahain ng administrative complaints, at sa pagpili ng kanyang designated representatives na magsasagawa ng fact-finding and formal investigation.
Ipinunto rin ni De Lima, ang procedure na nakasaad sa Department Circular, sakop ang lahat ng possible contingencies at pinahihintulutan ang necessary flexibility na matugunan ang sirkumtansiya ng bawat kaso, na siyang layunin ng Administrative Code, sa pagbibigay nito ng kapangyarihan sa Secretary of Justice sa pag-aksyon sa certain aspects.
“In other words, deleting those provisions will only make the implementing guidelines at the Department level incomplete. It is a fundamental rule that implementing rules cannot add to or detract from the provisions of the law it is designed to implement.”
“So, too, the possibility of forum shopping is inherent in the fact that the Admin Code authorized both the SOJ and the head of the agency to initiate administrative case. So, yes, it is a possibility, but that is why it is provided that those concerned shall inform the SOJ of the proceedings before them and, should they discover that there is duplication of proceedings relating to the same complaint, they are to seek guidance from the Secretary on how to proceed. In order to further address your concern, one of the modifictions we have made is to specify the requirements for the filing of a valid complaint, one of which is a certificate of non-forum shopping,” dagdag ng kalihim.
