C3E kay Sixto: Hoy sinungaling mag-sorry ka! (Comelec dapat sundin panawagan ni Pope kontra korupsiyon)

HINAMON kahapon ng Citizens for Clean and Credible Elections (C3E) si Commission on Elections (Comelec) chairman Sixto Brilliantes na mag-sorry matapos magsinungaling sa hearing ng joint congressional oversight committee (JCOC) on automated elections na nag-iimbestiga sa alegasyon ng iregularidad sa paggamit ng precinct count optical scan (PCOS) machines ng Smartmatic.

Ayon sa grupo, hindi pa huli ang lahat kay Brilliantes upang pakinggan ang panawagan ni Pope Francis na talikuran ang lahat ng uri ng korupsiyon at ituwid ang mga kabuktutan sa nakalipas.

Nanawagan din ang CC3E) sa mga lider ng dalawang kapulungan ng Kongreso na i-cite in contempt si Brillantes matapos sabihing hindi na siya lumalahok sa mga deliberasyon ng poll body kasama ang dalawa pang commissioners kaugnay sa pagdedesisyon sa mga bagay na may kinalaman sa paghahanda sa 2016 elections.

Sinabi ni Atty. Melchor Magdamo, C3E co-convenor, na nagsinungaling si Brillantes sa congressional panel sa pagdinig noong December 4.

Tinukoy ni Magdamo ang minutes ng meeting na sinabi ni Brillantes na dahil magreretiro na siya at ang dalawa pang commissioners, hindi na sila sumasali sa diskusyon sa Comelec tungkol sa kontrata para ma-renew ang serbisyo ng Smartmatic sa kabila ng kabiguan nitong resolbahin ang mga tanong hinggil sa accuracy at reliability ng PCOS machines.

Sa hearing, base sa minutes, sinabi ni Brillantes sa komite: “For the record, hindi na ho kami sumasali sa deliberations. Sa steering committee na. Silang apat. Kaming tatlo, medyo matatanda na kaunti. Hindi na kami sumasali (For the record, we don’t participate in deliberations anymore. It’s all in the steering committee. The four of them. We three are quite old already. We don’t participate anymore).”

Sinabi ni Magdamo na isa rin dating Comelec lawyer, na ang mga binitawang salita ni Brillantes ay malinaw na kasinungalingan.

“He lied through his teeth before the joint committee,” ayon kay Magdamo. “It’s very clear in the minutes of the JCOC meeting,” dagdag niya.

Aniya, malinaw na nakasaad sa Resolution 9922 ng Comelec en banc na nagsinungaling si Brillantes sa hindi nito paglahok sa mga deliberasyon sa PCOS machines at Smartmatic. Ang resolusyon na ipinakalat nang pasekreto noong December 23, inaprubahan sa pamamagitan ng 5-2 vote ang extended warranty agreement sa pagitan ng Smartmatic at Comelec para sa P300 million diagnostic inspection ng 82,000 PCOS machines.

Si Brillantes, kasama sina outgoing Commissioners Lucenito Tagle at Elias Yusoph, ay bumoto pabor sa kontrata, gayon din sina Christian Lim at Al Parreno. Sina Commissioners Arthur Lim at Luie Tito Guia naman ay bumoto kontra sa deal.

Ang hakbang ng Comelec ay binatikos ng watchdog groups, IT experts, Church and religious leaders, non government organizations, civic groups, at people’s organizations dahil sa hinalang “midnight deal” sa pagitan ng poll body at reseller na Smartmatic.

“How can he say he was not participating anymore when the resolution showed he actively took part in the act of practically gifting Smartmatic with the entire P2-billion project package before Christmas?” ayon kay Magdamo.

Hiniling ng abogado kina Senador Aquilino Pimentel III at Rep. Senen Sarmiento, co-chairs ng joint congressional committee, na i-cite in contempt si Brillantes.

“Brillantes testified under oath and that oath did not mean anything to him,” giit ni Magdamo. “He should be cited in contempt for lying not only to the committee but also to the Filipino people in his haste to the award multi-billion peso contracts to Smartmatic,” aniya.

Sa dissenting opinion, sinabi ni Commissioner Guia na ang refurbishment ng  PCOS ay dapat isagawa sa pamamagitan ng competitive public bidding sa ilalim ng Republic Act 9184, o mas kilala bilang Government Procurement Act.

“Transparency is key to gaining public trust and confidence in elections. Public bidding affords the public opportunity to observe the procurement phase of election preparation,” ayon kay Guia.

Inulit din nito ang naunang rekomendasyon ng Comelec Law Department noong November 4 na nagsusulong ng bidding para sa refurbishment contract.

Umaasa pa rin si Magdamo na maitatama pa rin ni Brillantes ang kanyang pagkakamali. “With the just concluded visit of Pope Francis, I hope that he took the time to reflect upon his actions, as many of us Filipinos did,” aniya.

“I pray that he heeded the Pope’s message to reject all forms of corruption, and that he be granted strength to recognize mistakes and to correct them,” dagdag ng abogado. Inihayag ng Santo Papa ang mensahe laban sa korupsiyon nang bumisita sa Malacañang sa harap ng mga opisyal ng pamahalaan at diplomatic corps.
