Comelec bugbog sarado na naman (Patakaran sa bidding ibinasura)

MAS tumindi pa ang pagbatikos laban sa Smartmatic kahapon nang sumama ang iba pang IT professionals ng bansa sa kampanya laban sa technology reseller matapos ibasura ng Bids and Awards Committee (BAC) ng Commission on Elections (Comelec) ang mga patakaran sa pagtukoy kung eligible nga ang naturang kompanya na sumali sa bidding para sa karagdagang optical mark reader (OMR) voting machines na gagamitin sa 2016 polls.

Kasabay nito, iginiit ng Philippine Computer Society (PCS) na hindi dapat pinagtatakpan ng BAC ang mga kapalpakan ng Smartmatic.

“The BAC has no choice but to declare Smartmatic ineligible based on your own rules,” ayon sa PCS.

Sa liham na ipinadala kay BAC chairperson Helen Aguila-Flores, binigyang-diin ni PCS President Leo Querubin ang mahigpit na paalala ng komite sa lahat ng bidders na maging maingat sa pagsusumite ng eligibility documents.

“I distinctly remember you (Flores) reminding the vendors that purchased eligibility documents to be very careful about their document submissions because a deficient document will disqualify them,” sabi ni Querubin sa kanyang liham, kasabay ng pag-alala na naroon siya sa pre-bid conference.

Inihayag din ni Querubin na agad diniskwalipika ang ibang bidders sa simpleng kadahilanan na hindi naka-notaryo ang kanilang mga dokumento.

Naguguluhan si Querubin dahil pinayagan ng BAC ang Smartmatic na maging eligible gayong kulang ang kanilang eligibility documents ng kinakailangang Tax Clearance Certificate, kabilang na ang depekto sa kanilang Articles of Incorporation.

Sa nasabing Articles of Incorporation, ang pangunahing layunin ng joint venture sa pagitan ng Smartmatic at Total Information Managment (TIM) ay para lamang sa automation ng 2010 national at local election.

Una nang inihayag ni Archbishop Emeritus Oscar Cruz ang kanyang intensyon na magsampa ng kaso laban sa Smartmatic base sa nasabing Articles of Incorporation na nangangahulugan na walang legal standing at non-existent ang Smartmatic-TIM.

Tinukoy din ni Querubin ang bahagi ng Clause 24.1 ng Section 2 ng Comelec bid documents na nagsasaad na:

“The BAC shall open the first bid envelopes (eligibility documents) of Bidders in public as specified in the BDS to determine each Bidder’s compliance with the documents prescribed in the ITB Clause 12. For this purpose, the BAC shall check the submitted documents of each bidder against a checklist of required documents to ascertain if they are all present, using a non-discretionary pass/fail criterion. If a bidder submits the required document, it shall be rated as pass for the particular requirement. In this regard, bids that fail to include any requirement or are incomplete or patently insufficient shall be considered as failed. Otherwise, the BAC shall rate the said first bid envelope as passed.”

Ipinaliwanag ni Querubin, dahil wala sa original submission ng Smartmatic ang Tax Clearance Certificate, bigo sila na makuha ang eligibility requirement, at hindi ang BAC ang magdedesisyon sa eligibility ng Smartmatic.

Idinagdag niya na kahit maisumite ng Smartmatic ang Tax Clearance Certificate sa mga susunod na submission, ang orihinal na isinumite ang dapat manaig, alinsunod sa Clause 19.3, Section 2 ng Comelec bid documents.

“The absence of the Jarltech Tax Clearance Certificate and the deficient Article of Incorporation of Smartmatic-TIM are more than enough grounds to disqualify Smartmatic,” paliwanag ni Querubin, kasabay ng pagbibigay-diin na wala sa diskresyon ng BAC ang pagdedesisyon sa nasabing usapin.

Pinagsabihan din niya si Chairperson Flores na, “The BAC has no choice but to declare Smartmatic ineligible based on your own rules.”

Muling tiniyak ng PCS sa Comelec na hindi sila magiging agresibo sa poll body at sa halip ay magsisilbi lamang silang tagapag-alala.

“This letter reminding you of your valid and timely warning during the pre-bid conference is in line with the PCS’ vigilant collaboration,” saad pa ni Querubin sa liham.
