AMINADO ang Palasyo na kaya nila inihirit sa Kongreso na gumawa ng batas na nagtatakda ng kahulugan ng “savings” sa pambansang budget ay upang mabalewala ang desisyon ng Korte Suprema na unconstitutional ang Disbursement Acceleration Program (DAP) ng administrasyong Aquino.
“The SC described the beneficial effects of DAP but at the same time stated that the Executive Dept.’s take on savings was wrong, how do we then remedy it or how do we ensure the beneficial effects to continue? The answer is if we want the positive effects to continue, then the Congress must redefine savings to ensure the beneficial effects continue,” paliwanag ni Presidential Spokesman Edwin Lacierda.
Ngunit iginiit ni Lacierda na hindi nila sinusuwag ang Korte Suprema dahil ang prinsipyo ng “checks and balances” ay pinahihintulutan na ituwid ang pagkakamali, kahit pa pinaninidigan ng Palasyo na wasto ang DAP.
“It is not circumvention because the principle of checks and balances precisely allow such a remedy,” depensa pa ni Lacierda sa paghingi ng saklolo ng Palasyo sa Kongreso .
Nauna nang inihayag ni Budget Secretary Florencio Abad sa budget hearing sa Kongreso na ang Kongreso lang ang may mandato na magbigay ng kahulugan sa “savings” hindi ang Korte Suprema.
“We go to Congress because inasmuch as Congress exercised its lawmaking power to define savings. It also has the power to redefine savings to preserve the gains and to give statutory basis for the Executive Dept. to implement projects covered by savings,” sabi ni Lacierda.
Magugunitang sinabi ni Korte Suprema na nilabag ng administrasyong Aquino ang 1987 Constitution nang kolektahin ang “savings” ng iba’t ibang ahensiya ng pamahalaan at ipinamahagi ito sa mga mambabatas para pondohan ang mga proyektong hindi inaprubahan sa pambansang budget.
Anang Kataas-taasang Hukuman, pwede lamang ideklara ang “savings” sa katapusan ng fiscal year, kapag ang layunin ng mga pondo ay nakamit o hindi na kailangan ang mga pondong ito.
