DAP illegal — SC (PNoy pasok sa impeachment)

HINARANG ng mga pulis ang grupo ng Anakpawis na nagkilos-protesta sa harap ng Supreme Court, at iginiit ang pagpapatalsik kay Pangulong Benigno Aquino III na tinagurian nilang pork barrel king, bunsod ng ipinatupad na Disbursement Acceleration Pr ogram (DAP). (BONG SON)

TIKOM ang bibig ng Palasyo sa naging desisyon ng Korte Suprema kahapon na unconstitutional ang ilang bahagi ng kontrobersiyal na Disbursement Acceleration Program (DAP) ng administrasyong Aquino.

Sinabi ni Deputy Presidential Spokesperson Abigail Valte, hindi muna magbibigay ng reaksiyon ang Malacañang sa usapin hanggang hindi pa nababasa ang buong desisyon ng Supreme Court.

“We will defer comment until we’ve read the full text of the decision,” aniya.

Kabilang sa idineklarang unconstitutional ng Kataas-taasang Hukuman sa DAP ang “*cross border transfers of the savings of the Executive to augment appropriation of other offices outside the Executive; funding of projects, activities and programs that were not covered by any appropriation in the General Appropriations Act; and withdrawal of unobligated allotment from the implementing agencies and the declaration of the withdrawn, unobligated allotments and unreleased appropriations as savings prior to the end of the fiscal year and without complying with the statutory definition of savings contained in the GAA.”

Batay sa petisyong inihain ng iba’t ibang grupo sa SC, nilabag ni Pangulong Benigno Aquino III at ng iba pang mga opisyal ng administrasyon ang esklusibong kapangyarihan ng Kongreso na magtakda ng pondo ng gobyerno.

Matatandaan, ibinunyag ni Sen. Jinggoy Estrada noong nakalipas na taon na namudmod ng milyon-milyong piso sa mga senador ang Palasyo mula sa pondo ng DAP para patalsikin sa pwesto si Chief Justice Renato Corona.

PNOY PASOK SA IMPEACHMENT

TINIYAK ng isang mambabatas, mahaharap sa impeachment complaint si Pangulong Benigno “Nonoy” Aquino III makaraan ideklara ng Supreme Court bilang unconstitutional ang Disbursement Accelaration Program (DAP).

Ayon kay Rep. Antonio Tinio, dapat nang tawaging pork barrel king si Aquino dahil sa pag-divert ng pondo nang walang basbas ng Kongreso.

“For sure, President Aquino will be facing an impeachment complaint when Congress reopens at the end of the month, and will certainly cast a dark cloud over his upcoming State of the Nation Address,” ratsada ni Tinio.

Pahayag pa ng mambabatas, nilabag ni Aquino ang Article 220 ng Revised Penal Code, kaya’t dapat lang siyang managot kasama si Budget Secretary Butch Abad.

Idiniin ni Tinio, dapat nang magbitiw sa kanyang pwesto si Abad, tinawag niyang chief architect at promoter ng DAP, at dapat ding makulong sa nasabing pagkakasala.

Kaugnay nito, sinabi nina Bayan Muna Reps.Neri Colmenares at Carlos Zarate, partial victory lamang ang naging desisyon ng Korte Suprema na unconstitutional ang DAP.
