Expropriation ng assets legal (Apela ng PECO ibinasura ng korte)

SA KAWALAN ng sapat na merito, ibinasura ng Iloilo Regional Trial Court Branch 23 ang motion for reconsideration na inihain ng Panay Electric Company (PECO) na humihiling na baliktarin ang nauna nang desisyon na nag-uutos ng expropriation ng mga assets nito pabor sa bagong Distribution Utility na More Power and Electric Corp (More Power).

Sa dalawang pahinang desisyon ng RTC, iginiit nito na wala nang prankisa para mag-operate ang PECO gayondin ay wala nang pinanghahawakang Certificate of Public Convenience and Necessity (CPCN) mula sa Energy Regulatory Commission (ERC) kaya wala nang legal na base­han para magpatuloy na maging power supplier ng Iloilo City.

“The court in its order sought to be reconsidered already cited the reasons why the court cannot grant the Omnibus Motion to enforce the Addendum and Urgent Ex Parte Motion. Defendant PECO has no more franchise and CPCN to operate. Dependant PECO should know this better as this has been what they have been invoking,” saad sa desisyon ni RTC Branch 23 Judge Emerald Requina-Contreras na may petsang 2 Hulyo 2020.

Iginiit ng korte na ang inisyu at ipinatupad nitong writ of possession ay naaayon sa law and jurisprudence, makailang beses pa umanong kinuwestiyon ng PECO ang nasabing kautusan sa pamamagitan ng paghahain ng iba’t ibang legal remedies ngunit maging ang Court of Appeals ay hindi binaligtad ang kanilang naging desisyon.

“Wherefore, finding no cogent reason to set aside or disturb its earlier order, the Motion for reconsideration is denied,” saad sa desisyon.

Ang kaso ay nag-ugat nang iutos ng RTC na ang assets ng PECO ay maaari nang i-expropriate o kunin ng More Power, kabilang dito ang Baldoza-La Paz substation (land including all machineries and improvements, buildings), General Luna substation (machinery), Tabuc Suba, Jaro substation (land, machinery), Bolilao, Mandurriao substation (land, buildings, and machinery) at  Avanceña Street, Molo substation (land, and buildings, machinery) na umaabot sa halagang P217,940,870.

Bukod dito ang meter lab, power plant building, at switchboard house na nagkakahalaga ng P14,792,680 ay dapat din ibenta ng PECO sa More Power.

Iginiit ng korte na ang assets na tinukoy nito para sa expropriation ay mahalaga para maipagpatuloy ang maayos na pagbibigay ng power supply sa consumers kasabay ng pagkansela ng prankisa ng PECO partikular ang mga electric meters, poles, transformers, transmission, distribution equipment, service vehicles at iba pang kagamitan para sa distribution, maintenance at troubleshooting activities.

Ang prankisa ng PECO ay nag-expired noong 19 Enero 2019, kasabay nito ay nilagdaan ni Pangulong Rodrigo Duterte noong 14 Pebrero 2019 ang Republic Act 11212 na nagbibigay sa MORE ng legislative franchise na mag-operate bilang solong Distribution Utility sa Iloilo City.

Nang matanggalan ng prankisa at CPCN ang PECO ay binawi na rin ni Iloilo City Mayor Jerry Treñas sa ipinalabas nitong executive order noong 8 May 2020 ang business permit na ibinigay nito sa PECO.

Tatlong beses na nagpasaklolo ang PECO sa Court of Appeals para baliktarin ang expropriation case decision ng Iloilo RTC ngunit ibinasura ito ng appellate court sa katuwirang legal ang expropriation ng assets ng PECO pabor sa More Power alinsunod sa itinatakda sa RA 11212.

Ibinasura rin nito ang hiling ng PECO na pigilan ang pagpapatupad ng writ of possession at hindi rin pinagbigyan ang hiling na magpalabas ng status quo ante order.

Kinikilala ng ERC ang technical capability at readiness ng MORE na mag-operate bilang distribution system.

Sa report na isinumite ng More Power sa ERC sinabi nito na mula nang i-takeover nila ang operasyon ng PECO noong Pebrero 2020 ay nagawa na nilang mapalitan ang may 109 bulok na mga posteng kahoy at ginawang concrete post, nasa 146 transformers ang napalitan, naisaayos na rin ang 133 hotspots na tinukoy na maaaring mag-overheat at 4,519 customer service ang kanilang natugunan.
