NTC umabuso, kastigo hamon kay Duterte ng ex-solon

HINAMON ng isang dating mambabatas si Pangulong Rodrigo Duterte na kastigohin ang National Telecommunications Commission (NTC) dahil

sa pag-abuso sa kapangyarihan nang iutos ang pagpapasara sa ABS-CBN habang umiiral ang Luzon-wide enhanced community quarantine (ECQ).

Ayon kay dating Kabataan party-list representative at Infrawatch PH convenor Terry Ridon, nag-isyu ang NTC ng Memorandum Order No. 03-03-2020 na nagpapalawig sa validity o bisa ng NTC permits, licenses at certificates nang hanggang 60 araw matapos matanggal ang ECQ, pero iniutos pa rin nila ang pagpapasara sa ABS-CBN sa panahon ng quarantine.

“In fact, the President should discipline the NTC for violating its own orders covering the quarantine period. They issued Memorandum Order No. 03-03-2020 which extends the validity of NTC permits, licenses and certificates sixty days after the lifting of the quarantine, yet they issued the closure order on ABS-CBN during the quarantine period. Clearly, this is nothing but a naked abuse of power,” ani Ridon sa kalatas.

Giit niya, malinaw ang batas na walang kompanya ang maaaring magsahimpapawid nang walang kaukulang prankisa mula sa Kongreso, ngunit sa kaso ng ABS-CBN ay mayroon itong prankisa at kailangan lamang ay renewal ng Kongreso.

“The NTC cannot apply this to ABS-CBN because the network had already obtained a franchise from Congress, it was now only a matter of renewal or denial by Congress. The requirement of ‘prior obtainment’ has been fulfilled,” aniya.

Maaari aniyang kasuhan ng graft ang NTC kapag iginiit ang ‘lohikang’ hindi maaaring mag-operate ang ABS-CBN sa expired franchise dahil may mga binigyan ang komisyon ng provisional authority sa ilang franchise holders na nagpatuloy sa pag-broadcast habang nakabinbin sa Kongreso ang franchise approval o denial.

“The NTC should carefully rethink the logic of their orders. If issuing a provisional authority to ABS-CBN pending the approval/denial of its legislative franchise constitutes graft, it follows that the same NTC officials are now liable for graft for previously issuing provisional authorities to other franchise holders that continued broadcasting pending legislative franchise approval/denial,” ani Ridon.

Ayon kay Presidential Spokesman Harry Roque, neutral si Pangulong Duterte sa isyu ng ABS-CBN  at kapag nakarating sa Pangulo ang panukalang batas na naggagawad ng franchise renewal sa network ay hindi niya ito tututulan.

“Yes, it’s to emphasize that he is neutral on the issue. And I think that would also indicate that if it reaches its desk, for as long as there is no constitutional infirmity, then he will not object to the law,” sabi ni Roque. (ROSE NOVENARIO)

Panawagan ito ng Malacañang Press Corps (MPC) sa hanay ng media para magkaisa sa harap ng pag-atake

sa pagpapasara ng National Telecommunications Commission (NTC) ang ABS-CBN.

Anila, ang hakbang na ito ng NTC ay tahasan at garapal na pag-atake sa malayang pamamahayag .

Sa kalatas ng MPC, sinabi nitong ang desisyon ng NTC ay kasunod ng banta ni Solicitor General Jose Calida na sasampahan ng kasong graft ang mga opisyal ng komisyon kapag binigyan ng provisional authority ang ABS-CBN.

Ito ay sa kabila ng naunang komitment ni NTC Commissioner Gamaliel Cordoba sa House Committee on Legislative Franchises na pagkakalooban ng provisional authority ang broadcast company.

Matatandaan na si Calida ang naghain ng quo warranto petition sa Supreme Court laban sa ABS-CBN noong Pebrero 2020 matapos ang sunod-sunod na pahayag  ni Pangulong Rodrigo Duterte na haharangin niya ang franchise renewal ng broadcast company.

“Since 2014, Congress sat and dilly-dallied on ABS-CBN’s application to renew its franchise until it was too late on May 5, 2020 – one of the darkest moments in the history of Philippine media,” anang MPC.

Ang mga nasabing pangyayari ay malinaw na pagsasabwatan para atakehin ang ABS-CBN at sa kabuuan ay pag-atake sa press freedom ng mga ahente ng gobyerno na nais lamang sumisipsip sa kanilang amo.

“The confluence of events shows us that this is an orchestrated attack in part against ABS-CBN, and on the whole, an attack against press freedom by agents of the government who are only too willing to please their master. They have done it before. They are doing it again,” pahayag ng MPC.

Hiniling ng MPC na tuparin ng NTC ang ipinangako sa Kongreso na bigyan ng provisional authority ang ABS-CBN at ipaubaya sa Kongreso ang usapin ng franchise renewal.

“We stand in solidarity with ABS-CBN and its more than 11,000 workers, whose livelihoods are now at risk because of the NTC’s unreasonable and imprudent action,” mariing pahayag ng MPC. (ROSE NOVENARIO)

BINATIKOS ni Albay Rep. Edcel Lagman ang administrasyon sa pagsisi sa National Telecommunication Commission (NTC) sa ipinataw na cease-and-desist order laban sa ABS-CBN.

Ayon kay Lagman bigo ang liderato ng Kamara sa pag-aproba ng prankisa na inihain noon pang 2016.

“There is no other solution to the dilemma of ABS-CBN than the immediate renewal of its franchise now that the Congress is in session,” ani Lagman.

“I have repeatedly warned that Speaker Alan Peter Cayetano’s proffered solution for NTC to grant ABS-CBN a provisional authority to operate, despite the lapse of its franchise, is against the law and jurisprudence,” ani Lagman.

Paliwanag niya, ang Section 16 ng RA 7925 o ang “Public Telecommunications Policy Act” ay maliwanag sa pagsasabi ng “No person shall commence or conduct the business of being a public telecommunications entity without first obtaining a franchise.”

Ani Lagman, ang Korte Suprema sa kaso ng Associated Communications and Wireless Services United Broadcasting Networks vs. NTC, sinabi nito na “As long as the law remains unchanged, the requirement of a franchise to operate a television station must be upheld.”

Aniya, hindi sana nagsara ang media network kung nasa tamang oras ang pagdinig ng kamara sa renewal ng prankisa.

Naalala ni Lagman, noong pag-upo ni Pangulong Rodrigo Duterte sa Malacañang, sinabi niyang hindi niya pipirmahan ang prankisa ng ABS-CBN dahil hindi umano, ini-ere ang kanyang political ads noong 2016 elections.

Kalaunan tinanggap ng pangulo ang paumanhin ng ABS-CBN.

“The shuttering of ABC-CBN highlights the verity that the House must exercise its constitutional powers independently and without succumbing to the President’s intervention,” giit ni Lagman.

Sa panig ni Cagayan de Oro Rep. Rufus Rodriguez, dapat nang bigyan ng Kamara ng provisional na prankisa ang ABS-CBN hangang 30 Hunyo 2022.

“I am filing today a new joint congressional resolution granting the temporary franchise. I am hoping we can expedite the hearings on this measure amid the COVID-19 pandemic even if we have to hear all stakeholders through the new normal videoconferencing platform,” ayon kay Rodriguez.

Maghahain din siya ng panukala na bigyan ng 25 taong prankisa ang kompanya.

“It has to be a new grant and no longer a renewal, since the radio-TV station’s franchise already expired midnight of last May 4,” aniya.

“It was unfortunate that the National Telecommunications Commission (NTC) chose to ignore the collective voice of the House and the Senate for it to issue a provisional authority to ABS-CBN to allow it to pursue its broadcast services,” ayon kay Rodriguez.

Si Buhay Party-list Rep. Lito Atienza, sa interbyu sa ANC, humingi ng paumanhin sa taongbayan sa pagsasara ng ABS-CBN.

“I would like to apologize for the failure of Congress to do its job. Kasalanan namin ito e. Kasalanan ng Kongreso ito. But more important, I would like to say squarely, kasalanan ni Speaker Cayetano ito. Pagkukulang niya ito sa bayan, he will have a lot to explain one day. It may not be today but later on this issue will hound him because he’s the one who did not do his job,” ani Atienza.

Para kay TUCP Party-list Rep. Raymond Democrito Mendoza nakababahala ang ginawa ng NTC sa ABS-CBN… nawalan ng trabaho ang higit sa 11,000 empleyado.

“With a single stroke of the pen, an unfeeling NTC has rendered 11,000 workers jobless, increasing the vulnerability of these workers and their families to both the ravages of COVID-19 and the economic recession. Truth and the ABS-CBN workers are the first victims of the NTC order,” ani Mendoza.

Aniya, ang pangalawang biktima ay taongbayan. “The second victims of NTC will be the nation as a whole.  Mean-spirited and unwise, the NTC Order will effectively raise COVID-19 incidence as our poorest people, without the distraction of their favorite TV shows inside their super-heated, locked down homes, start congregating outside their crowded communities without physical distancing. Further, without recourse to their trusted and credible news sources, people will be left adrift in the miasma and mess of fake news and myths that populates other media,” pahayag ni Mendoza. TINIYAK ni Senate President Vicente Sotto III, agad aaprobahan ng Senado ang prankisa ng ABS CBN.

Pahayag ito ni Sotto matapos itigil ng ABS-CBN ang pagsasahimpapawid bilang pagtalima sa

cease-and-desist order ng National Telecommunications Commission (NTC) matapos mapaso ang kanilang prankisa.

‘“ABS franchise, bring it to the Senate, we will approve it!” pahayag ni Sotto sa kanyang official Twitter account.

Umaasa si Senator Grace Poe na gagawin ng kanyang mga kapwa mambabatas, sa Senado at Kamara, ang tama kaugnay sa pagpapasara sa ABS-CBN.

Sinabi ni Poe dapat gawin nila kung ano ang kanilang mandato ayon sa Saligang Batas para protektahan ang freedom of the press at freedom of expression at aniya dapat ito rin ang ginagawa ng gobyerno.

Lumikha aniya ng mga katanungan ang naging hakbang ng NTC, gaya ng kung ang pagpapasara sa ABS-CBN ay ayon talaga sa estriktong pagsunod sa batas o kung ito ba ay pag-atake sa media at sambayanan.

Tanong din ni Poe, kung ito ay makatuwiran inilalagay din ng mga taga-media ang kanilang sarili sa panganib dahil sa patuloy na pagtatrabaho sa gitna ng kasalukuyang krisis.

Kinuwestiyon ni Poe ang kahandaan ng gobyerno sa napipintong pagkawala ng trabaho ng libo-libong inaaasa ang kabuhayan bilang empleyado ng ABS-CBN.

Nagpahayag ng pagkabahala si Sen. Risa Hontiveros dahil napakahalaga ng ginagawa ng ABS-CBN ngayong lumalaban ang bansa sa COVID-19 dahil ang pagbibigay ng tamang impormasyon ay napakahalaga sa sitwasyon ngayon.

Dapat dalhin ng ABS-CBN ang isyu sa Korte Suprema, ayon kay Sen. Francis Pangilinan sa paniwalang nagkaroon ng pag-abuso sa bahagi ng NTC dahil sinabi na mismo ni Justice Secretary Menardo Guevarra, maaring magbigay ng provisional authority ang NTC para sa patuloy na operasyon ng media network.

Sinabi ni Sen. Christopher Go, nasa Kamara ang bola at dapat kumilos ang mga kongresista.

Dagdag niya, sakaling umabot sa Senado ang prankisa, ang kanyang magiging boto ay base sa kanyang konsensiya at para sa interes ng sambayanang Filipino.

Panghihimasok naman sa lehislatura, ayon kay Sen. Richard Gordon, ang ginawa ng NTC dahil nasa deliberasyon ng mga mambabatas ang prankisa.

Ayon kay Gordon, kung may mga paglabag ang ABS-CBN sa kanilang franchise agreement, hayaan ang hudikaturang magdesisyon at magpataw ng kinauukulang multa. (CYNTHIA MARTIN)
