Good moral certificate ipinagkait sa salutatorian

MAKARAAN mabigo sa husgado at sa paaralang pinagtapusan noong high school, nagpapasaklolo sa Court of Appeals (CA) ang salutatorian ng Santo Niño Parochial School (SNPS) sa Quezon City, na si Krisel Mallari upang obligahin ang nasabing eskwelahan na magpalabas ng certificate of good moral character na kailangan niyang maisumite sa University of Santo Tomas (UST) na kuwalipikado siya sa kursong accountancy.

Ang extremely urgent petition (for certiorari and mandamus with prayer for temporary restraining order/writ of preliminary injunction and motion to submit case for oral Aargument), ng 16-anyos na si Krisel, ay inihain sa CA sa pamamagitan  ng kanyang amang si Ernesto Mallari at ni Public Attorneys’ Office (PAO) chief, Atty. Persida Rueda Acosta dahil siya ay menor de edad at wala pang trabaho o ano mang pinagkakakitaan.

Kabilang sa mga respondent sa petisyon si Judge Alfonso Ruiz ng Quezon City  Regional Trial Court Branch 216, ang Santo Niño Parochial School (SNPS) at school registrar na si Mrs. Yolanda Casero.

Sa kanyang petisyon, iginiit na nakagawa ng grave abuse of discretion si Judge Ruiz nang hatulan agad ang kanyang petisyon nang magpalabas ng order ang DepEd na walang derogatory record sa SNPS si Krisel, bagama’t hindi pa ito naipripresenta sa korte.

“…the RTC practically disposed of the merits of the application for injunctive relief and worse, of the case…  when the hearing on Krisel’s application was discontinued, presentation of her evidence was not yet concluded; and SNPS and Mrs. Casero have yet to present their evidence…By stating that the school cannot be compelled to issue a certificate if indeed the student lacks good moral character… the RTC already arrived at a conclusion on the character of Krisel,” ayon sa petition.

Ayon pa sa PAO chief, kaduda-duda rin na agad pinanigan ng hukom ang SNPS at registrar na si Casero nang ideklara na rasonable ang hindi pagpapalabas ng certificate of good moral character para sa salutatorian.
