INIHAYAG ni Justice Secretary Leila de Lima kahapon, hindi mapupwesa ng Comelec ang mahigit 400 elected officials na bakantehin ang kanilang pwesto bunsod ng hindi paghahain ng kanilang statement of contributions and expenditures (SOCEs).
Sinabi ni De Lima, na hindi maaaring makapag-utos ang Comelec sa Department of Interior and Local Government at House of the Representatives na alisin ang elected officials sa pwesto.
“Hindi nga tama iyon na in a mere letter they will direct both the DILG and Speaker of the House to order or direct the elected officials concerned to vacate from office. A mere letter is not enough … does not suffice,” diin ni De Lima.
Dagdag pa ng kalihim, ang pinakamabisang remedyo na dapat gawin ni Elections chair Sixto Brillantes Jr. ay maghain laban sa mga opisyal ng “Quo warranto” case sa korte.
“The grounds for quo warranto is ineligibility to continue holding office and dito in this particular case, mandatory ang requirement na yun bago mag assume ng office kailangan mayroong certificate of compliance or certificate of submission nung SOCE,” pahayag ni De Lima.
