Debbie talo sa isinampang kaso kay Barbie

IBINALITA ni Ogie Diaz sa kanyang latest vlog na ibinasura ng piskalya ang tatlong kaso na inihain ng Vivamaxstar na si Debbie Garcia laban kay 

Ayon kay Ogie, ang dahilan ng pagkaka-dismiss ng mga reklamo ni Debbie ay ang kakulangan nito ng ebidensiya.

Inireklamo last year ni Debbie si Barbie Imperial ng slight physical injury, grave oral defamation, at grave slander by deed. Ito’y dahil aniya ay sinaktan siya ni Barbie  habang nasa isang bar sila sa Quezon City noong October 28, 2022 na ang dahilan daw ay selos.

Narito ang naging desisyon ng piskalya na binasa ni Ogie.

“The alleged defamatory remarks and other acts intended or calculated to cast dishonor, discredit or contempt upon the Complainant that would constitute the crimes of Grave Oral Defamation and Slander by Deed are not evident in the CCTV footages attached to the complaint. There seems to be no further verbal confrontation that transpired, after the more or less two (2) second commotion, between the parties at the time of the incident.

“What is evident from the CCTV Footages is that the parties were immediately pulled away from each other after a brief commotion, and nothing ensued thereafter. Respondent was not even seen making a remark towards the Complainant based on the CCTV Footages and there was no recording that Respondent was grabbing and pulling the Complainant’s hair, scratching her chest, neck and arm, and kicking her leg. 

“WHEREFORE, in view of the foregoing, the undersigned finds that the charges against the Respondent Barbie Imperial y Concina, alias “Barbie Imperial” for Slight Physical Injuries under paragraph 1, Article 266 of the Revised Penal Code, Grave Oral Defamation under Article 358 of the Revised Penal Code and Grave Slander by Deed be DISMISSED due to INSUFFICIENCY OF EVIDENCE.”

After mabasa ang desisyon ng korte, sinabi ni Ogie na ang ginawa nitong batayan ay ang CCTV, na hindi naman umano nagdikit sina Debbie at Barbie that night. Kaya kinuwestyon ng korte kung saan nanggaling ang mga kalmot ni Debbie. Kaya ang kaso ay nabasura.
