‘OPLAN BAKLAS’ NG COMELEC UNCONSTITUTIONAL

HINDI saklaw ng regulatory powers ng Commission on Elections (Comelec) ang pribadong mamamayan kaya walang karapatan ang poll body na panghimasukan ang pribadong espasyo na inilalaan nila sa sinusuportahang partido o kandidato.

Ito ang naging desisyon ng Korte Suprema na nagsisilbing jurisprudence o palabatasan sa mga naging kaso laban sa Comelec kaugnay ng Oplan Baklas na isinampa ng pribadong mamamayan.

Inulan ng batikos ang Comelec matapos utusan ang law enforcers na tanggalin ang oversized campaign materials kahit nasa loob ng pribadong lugar.

“Private citizens are not covered by Comelec regulatory powers. Private citizens’ right to campaign is an exercise of freedom of speech and expression,” ayon kay election lawyer Emil Maranon III sa panayam sa The Chiefs sa One News kagabi.

Sinabi ni Maranon, ang desisyon ng Korte Suprema noong 2015 ay hinggil sa kaso ng isang pari na nagsabit ng malaking poster ng senatorial bets na bumoto ng pabor at kontra sa noo’y Reproduction Health bill.

“In that decision written by Justice Leonen, sinabi ng Korte Suprema, ‘if an expression is made by a private citizen, it is outside of the regulatory powers of the Comelec.’ Meaning po puwede lumagpas ng 2 feet x 3 feet as in the case of the priest in Bacolod, hindi po ito violation ng batas because this is considered part of protected speech,” anang election lawyer.

“So klaro po roon ang Supreme Court, at they made two categories, one that belong to political parties/candidates which is sakop kayo ng regulatory powers ng Comelec. On the other hand if you’re a private citizen, sinasabi roon na hindi po kayo sakop o saklaw ng kapangyarihan ng Comelec na i-regulate ang eleksiyon,” dagdag niya.

Base aniya sa diskusyon sa kaso sa Diocese sa Bacolod, “if you really believe in the candidate in pursuit of your advocacy, you want to put a poster na ganyan kalaki po then you are perfectly allowed by the Constitution to do that, as simple as that because hindi nga kayo sakop ng 2 x 3 feet na regulation ng Comelec. Ganoon kasimple po ang rule ng Korte Suprema.”

Hinimok niya ang poll body na makinig sa mga reklamo laban sa Oplan Baklas dahil mismong Kataastaasang Hukuman na ang nagpahayag na kapag ang naglalaban ay right to free speech at regulatory powers ng Comelec, dapat manaig ang right to free speech dahil nakasaad ito sa Konstitusyon.
