Albee Benitez absuwelto sa kaso, nakiusap ng privacy

ABSUWELTO si Bacolod City Rep. Albee Benitez laban sa kasong isinampa ng dating asawang si Nikki Lopez kaugnay ng usaping “pangangaliwa.”

Sa 20-pahinang resolusyon, sinabi ni Assistant City Prosecutor Mikhail Maverick Tumacder na bigo si Lopez na makapagsumite ng sapat na ebidensiya sa reklamong paglabag sa Republic Act 9262 o Anti-Violence Against Women and Their Children Act of 2004 laban kay Rep. Benitez.

Nauna rito, inakusahan si Benitez ng umano’y pakikipagrelasyon sa ibang mga babae, kabilang ang aktres na si Ivana Alawi.

Sa complaint affidavit ni Lopez, inilahad nitong naapektuhan ang kanyang mental health sa pagkakaroon daw ng “anak sa labas” ni Benitez sa isang aktres at sa isang dating beauty queen.

“On a final note, while this office commiserates with whatever complainant has gone through, the office has to take consideration the lack of evidence to support her case of violation of RA 9262. Under the provision of D.C. No. 15, the evidence required exacts more than probable cause i.e prima facie evidence with reasonable certainty of conviction of the accused when the case is tried in court,” ayon sa resolution.

Hindi raw nakapagbigay ng sapat na ebidensya para mapatunayang nagkaroon ng relasyon si Benitez sa dalawang female celebrity.

Wala rin daw naisumiteng pruweba si Lopez kaugnay ng umano’y relasyon ng dating mister kay Ivana. Puro news articles, litrato, at testimonya ng kapatid ang nasa complaint na sapat para sumampa ang kaso sa korte.

“To accept the same as gospel truth, without corroborating sworn statements to explain what is being depicted in these photographs, is a dangerous precedent. 

“The evidence submitted does not constitute sufficient proof to charge  someone with a criminal indictment,” bahagi ng resolusyon.

“Wherefore, it is respectfully recommended that the complaint for RA No. 9262 otherwise known as Violation Against Women and their Children against respondents Alfredo “Albee” Bantug Benitez be dismissed for insuffiency of evidence,” ayon pa sa resolution na may pirma ni Assistant City Prosecutor Mikhail Maverick P. Tumacder at inaprubahan ni Senior Assistant City Prosecutor Melvin A. Matti.

SA kabilang banda, sinabi naman ni Cong. Benitez sa pamamagitan ng isang press statement na ang pagkakabasura sa kaso ay isang kompirmasyon na ang hustisya sa ating bansa ay buhay pa at ang lahat ay maaaring humingi ng tulong anumang oras at pagkakataon.

Sinabi pa ni Benitez na ipahinga na ang kabanatang ito. At umapela sa lahat, lalo na sa mga miyembro ng media at sa publiko na bigyan sila ng privacy habang lahat sila ay nagmo-move on sa mga nangyayari.
