SLV nilagdaan ni Duterte (Sa bisperas ng ASEAN Summit)

NILAGDAAN ni Pangulong Rodrigo Duterte ang Proclamation on State of National Emergency on Account of Lawless violence bago siya umalis patungong Laos para dumalo sa ASEAN Summit.

Sa press briefing sa Palasyo kagabi, sinabi ni Communications Assistant Secretary Kris Ablan, ang natu-rang proklamasyon ay alinsunod sa kapangyarihan ng isang Punong Ehekutibo base sa 1987 Constitution.

Aniya, layunin nito na sugpuin ang terorismo sa Mindanao at pagkalat ng karahasan sa iba’t ibang parte ng Filipinas.

“No loss of civil and political liberties,” ani Ablan.

Nanawagan siya sa publiko na huwag mabahala at iiral aniya ang naturang proklamasyon habang hindi pa lubos na nasusugpo ang terorismo.

Tiniyak ni Ablan, walang batas na suspendido habang ipinatutupad ang state of lawless violence kahit ang Human Security Act o Republic Act 10168.

Base sa Section 7 ng RA 10168, puwedeng hilingin ng awtoridad sa Court of Appeals na ipag-utos na isailalim sa surveillance at i-wiretap ang sino mang indibid-wal na tumutulong sa tero-rista.

“Sec. 7 Surveillance of Suspects and Interception and Recording of Communications – The provisions of Republic Act No. 4200 (Anti-Wire Tapping Law) to the contrary notwithstanding, a police or law enforcement official and the members of his team may, upon a written order of the Court of Appeals, listen to, intercept and record, with the use of any mode, form, kind or type of electronic or other surveillance equipment or intercepting and tracking devi-ces, or with the use of any other suitable ways and means for that purpose, any communication, message, conversation, discussion, or spoken or written words between members of a judicially declared and outlawed terrorist organization, association, or group of persons or of any person charged with or suspected of the crime of terrorism of conspiracy to commit terrorism. Provided, that surveillance, interception and recording of communications between lawyers and clients, doctors and patients, journalists and their sources and confidential business correspondence shall not be authorized.”

Matatandaan na pinalagan ito ng iba’t ibang media groups dahil paglabag ito sa kalayaan sa pamamahayag dahil maaaring magamit sa harassment sa journalists na nagko-cover ng violent crime, terrorism at conflict.

Sinabi ni Executive Secretary Salvador Medialdea, nagbigay-daan sa paglalabas ng proklamasyon ni Duterte ang terror attacks gaya ng kidnapping, pamumugot at pambobomba ng Abu Sayyaf Group sa Davao City Night Market at jailbreak sa Lanao del Sur na kagagawan ng Maute Group.

Wala aniyang probisyon na nagtatakda ng curfew at tinanggal nila ang mga detalye , partikular sa illegal drugs bilang isa sa mga dahilan ng proklamasyon.

Inilinaw niya na terorismo ang pangunahing dahilan ng paglalabas ng proklamasyon at hindi drug-rela-ted incidents.
