1 pang BI employee kinasuhan ng graft si Mison

NAHAHARAP sa karagdagang kasong kriminal si Bureau of Immigration Commissioner Siegfred Mison makaraang sampahan ni NAIA Terminal I head supervisor Maria Rhodora Abrazaldo ng graft and corruption.

Inakusahan ni Abrazaldo si Mison ng paglabag sa Sec. 3 (e) ng Republic Act 3019, bunsod ng pagdudulot ng “undue injury to the government and given the private party unwarranted benefits, advantage and preference in the discharge of his official administrative functions through manifest partiality, evident bad faith and gross inexcusable negligence.”   

Noong Mayo 22, 2015, nagsumite ang immigration head supervisor ng ‘petition for prohibition with application for preliminary injunction and temporary restraining order’ sa Branch 111 ngPasay City Regional Trial Court makaraan ang sinasabing ‘arbitrarily and oppressively’ reassignment sa complainant sa Zamboanga International Seaport na nagdulot ng ‘great and irreparable damage’ kay Abrazaldo.

Sinasabing may problema sa ‘peace and order’ sa nasabing rehiyon kung saan ipinatatalaga si Abrazado, na nagresulta sa ‘financial and geographical dislocation’ laban sa complainant.

Noong Hunyo 2, 2015, sumulat si Abrazaldo kay Mison, at ipinaalam sa commissioner na “(she could not) assume (her) reassigned position in Zamboanga Seaport due to the pending appeal before the Civil Service Commission,” makaraan maghain ng aplikasyon para mag-leave sa nabanggit na buwan.

Gayonman, noong Hunyo 30, 2015, si Atty. Liza Julie Madera, acting chief ng Immigration personnel section, at si Rogelio Gevero Jr., acting chief ng BI administrative division, ay nag-isyu ng memorandum na nagbasura sa leave application ni Abrazaldo at iniutos sa kanyang mag-report sa kanyang ‘reassignment’ sa Zamboanga International Seaport.

Noong Hulyo 25, 2015, muling naghain ang complainant ng leave para sa buwan ng Agosto, 2015, muling binanggit ang pending appeal sa Service Commission at prohibition case sa Regional Trial Court of Pasay City, Branch 111.

Ngunit makaraan ang tatlong araw, si Chonalyn Catacutan, hepe ng BI administrative and personnel section, ay nag-isyu ng ‘unlawfully’ bilang tugon, ng isa pang memoramdum, tinukoy ang undated Immigration Administrative Order No. SBM-2015-015 upang igiit kay Abrazaldo “to report for work pursuant to 20 May 2015 Personnel Order No. SBM-2015-A-218,” at binigyang-diin na ang pagliban ng complainant ay hindi awtorisado.

Ito ay sinundan ng show cause memorandum mula kay Atty. Ronaldo Ledesma noong Agosto 13, 2015, nag-uutos kay Abrazaldo na magsumite ng ‘written explanation under oath’ kaugnay ng hindi niya pag-report sa kanyang assignment sa Zamboanga International Seaport noong Mayo 25, 2015.

“Your explanation must state the reason why no administrative cases should be filed against you.  Failure to comply shall be considered a waiver and the preliminary investigation may be completed even without the said explanation,” ayon sa memorandum.

Sa kabila ng sinasabing pagiging ilegal nang naunang aksyon ni Atty. Ledesma, inihain ng complainant ang kanyang ‘reply’ noong Agosto 17, 2015, para sa nasabing show cause memorandum ngunit nabatid na wala itong saysay dahil nag-isyu na si Mison ng order noong Agosto 14, 2015 “dropping complainant from the rolls.”

Bunsod nito, sinabi ni Abrazaldo na siya ay pinagkaitan ni Mison ng due process, alinsunod sa Section 46 (a) ng Civil Service Law, nagsasaad na “no officer or employee in the Civil Service shall be suspended or dismissed except for cause as provided by law after due process.” (VC)
