3. Pocketing an estimated amount of P1.5 million the BI Express Trust Fund by way of giving himself an Overtime Pay and Bonuses.- On amount of the peculiar service performed by BI personnel extending to off-hours,they may be assigned to do overtime work when the service rendered is to be paid for by shipping company and airlines or other persons serbed (Sec.7-A,CA 613,as amended). To defray the cost of overtime compensation and possible bonuses of its employees, the Bureau collects overtime charges from airlines and shipping companies and Express Lane fees from individuals served. The amounts are deposited in a fiduciary non-appropriated Express Lane Trust Fund from which the employees’ OT pay and bonuses are drawn. Under Section 284 of the Government Accounting Rules and Regulations (GARR), a Bureau Director (such as Commissioner MISON) is not entitled to Overtime Pay. Despite his knowledge thereof he being a lawyer,and contrary thereto,MISON has been regularly giving himself and collecting about P75,000.00 a month in Overtime plus bonuses since his assumption as BI Commissioner, in the estimated totl amount of P1.5 Million to date and running. Every peso pocketed by MISON from Express Lane Trust Fund without legal right or authority diminished by so much the amounts to be paid to the rank and file. (OMB Case No.IC-OC-15-0865 filed on 11 June 2015, titled Faizal U. Hussin vs. Commissioner Siegfred B. Mison.

The attempt of Commissioner MISON to claim reimbursement of undue gasoline consumption,etc. as afore-descrived,and his consummated and continuing receipt of Overtime Pay contrary to regulations,constitute corrupt practices. Corruption consists in the act of an official  or fiduciary person who unlawfully and wrongfully uses his station or character to character to procure some benefit for himself or for another person,contrary to duty and the rights of others. (Black’s Law Dictionary, p345;CSC v. Belagan,G.R. No.132164, 19 Oct.2004).

His act of coddling the illegally-staying FU GAIFENG and YUAN JIN HUA @ Wilson Ong Cheng is part from other cases he is now facing before the Office of the Ombudsman.

No one believes that no money changed in those two incidents at least.

Hence,Mr.President,if you desire the Government to remain along the straight path in this last year of your administration, remove SIEGFRED B. MISON as Commiessioner of the Bureau of Immigration now while there is still time for the agency to recover its bearing.
