E, bakit pinaglalaruan ni Erap ang ating Batas? Ignorance of the Law Excuses No One.@#$%^&*()! Yan. Ano-ano ang mga karapatan na nawala sa isang criminal kapag siya’y nahatulan ng hukuman ng Reclusion Perpetua o Habambuhay na pagkabilanggo?
Under article 27 of the Revised Penal Code of the Philippines (RPCP),any person sentenced to life imprisonment shall be imprisoned for at least 30 years,unless pardoned earlier. After 30 years, he shall be entitled to pardon unless by reason of his conduct or some other serious cause the president shall consider him as unworthy of pardon.
The additional penalties of
a).Civil interdiction.
b).Perpetua (lifetime)-absolute disqualification from holding public office.
Civil interdiction deprives a conduct of the rights of parental authority,marital authority or guardianship over persons and property, of the rights to manage his property or dispose of them (Art.34,RPCP).
What are the effects of perpetual absolute disqualification?
They are:
a).Dismissal from any public office or employment, including public conferred by popular election. In the case of Erap, he was dismissed from the office of the President of the Republic of the Philippines.
b).Deprivation of the right to vote in any election for any popular office he cannot vote or be elected to any public office.
c).Disqualification for any public office or public employment.
d).Loss of all rights to retirement pay or other pension for any office formerly held. (Art 30, RPCP).
Section 2 of Republic Act No. 7080, also known as an act defining and penalizing the crime of plunder, provides that any “public officer…who amasses,accumulate or acquires illgotten wealth…in the aggregates amount or total value of at least fifty million pesos (P50,000,000.00) shall be guilty of plunder and shall punished by Reclusion Perpetua to Death.
The Government money Plundered by Erap exceeded the amount of P50 million by more three Billion, P200 million pesos.According to the Ombudsman.
On Oct.25,2007, President Gloria Macapagal-Arroyo granted Estrada a pardon. The pardon document declares that:
Whereas, Joseph Ejercito Estrada has publicly committed to no longer seek any elective position or office.
“In view hereof and pursuant to the authority conferred on me by the Constitution. I hereby grant executive clemency to Joseph Ejercito Estrada, convicted by the Sandiganbayan of Plunder and imposed a penalty of Reclusion Perpetua.
The forfeitures imposed by the Sandiganbayan remain in force and in full,including all writs and processes issued by the Sandiganbayan in pursuance hereof, except for the bank account(s)he owned his tenure as president.
Upon acceptance of this pardon by Joseph Ejercito Estrada,this Pardon shall take effect.
Given under my hand at the City of Manila,this 25th day of October,in the Year of Our Lord,two thousand and seven.

Estrada apparently violated the condition to his pardon “to no longer seek any electives position or office when he ran for president in 2010 and gain announced his Candidacy for Mayor of Manila last May 13,2013 election and won?
Many lawyers and legal scholars believe that the pardon granted by then President Arroyo to Erap in “Null and Void” because of the violation of a condition for the pardon.
