MWSS nagklaro sa Concession Agreements

INILINAW ni Metropolitan Waterworks and Sewerage System (MWSS) ang mga mali-maling lumabas na espe­kulasyon o impormasyon tungkol sa concession agreements sa Maynilad Water Services, Inc. (MWSI) at Manila Water Services, Inc. (MWCI).

Base sa inilabas na statement ni MWSS Administrator Emmanuel B. Salamat, ipinaliwanag niya na dahil sa bilis ng mga pangyayari at iba’t ibang nailathala sa media ay nagresulta ng mga di-wastong espekulasyon sa isyu at nagkaroon ng hindi pagkakaunawaan ukol dito kaya nais nilang malutas ito.

Ayon kay Salamat, nitong nakaraang Linggo, may ginawang aksiyon ang MWSS sa pama­magitan ng kanilang Board of Trustees, kaugnay sa mga naging anunsiyo ng Pangulong Rodrigo Duter­te at iba pang ahensiya ng pamahalaan tungkol sa concession agreements ng Maynilad at Manila Water.

Sa simula pa lamang aniya ay nilinaw na nila na ang ‘subsisting con­tract’  na  25 taon ng Con­cession Agreements na nagsimula noong taong 1997 sa Maynilad at MWCI ay umiiral pa rin at sa taong 2022 pa magtata­pos.

Ang MWSS Board Resolution No. 2019-201-CO na may petsang December 9, 2019, ay ipinapawalang bisa lamang ang dating Board Reso­lution No. 2009-72 na may petsang April 16, 2009 para sa ‘extension period’ mula 2022 hanggang 2037 ng Manila Water Company and Board Resolution No. 2009-180 na may petsang September 10, 2009 para rin sa ‘extension of con­cession period’ mula 2022 hanggang 2037 ng Maynilad Water Services, Inc.

“This action of the Board did not result in the rescission or outright cancellation of the said contracts, which requires a separate and distinct act to be legally effective. As such, the government through the MWSS is giving the two Concessionaires the opportunity to renegotiate and agree on the new terms of the Concession Agreement,” saad sa opisyal na pahayag ng MWSS.

At sa katunayan, dahil sa mga naging deklara­syon  ukol dito ng pama­halaan ay inatasan ng MWSS ang muling pagne­negosayon ng Concession Agreements sa Manila Water at Maynilad upang alisin ang ‘llegal and onerous provisions’ at madetermina ng Department of Justice, at maisama ang mga probisyon na maka­pagbibigay ng benepisyo sa mga consumer sa buong bansa.

“MWSS is fully engaged in continuing to ensure the performance of its mandates under Republic Act No. 6234, as well as to achieve the pur­pose for, and the intention behind, the directives of the President. It is committed to materially con­tribute to the satisfactory resolution of the various issues for all the stake­holders,” ayon kay Salamat.

Kaugnay nito ay pina­salamatan din ng MWSS administrator ang ipina­malas na kooperasyon ng dalawang conces­sion­aires, hindi lamang ang kanilang pagdedeklarang hindi sila mangongolekta o magpapatupad ng kama­kailan lamang na ‘arbitral awards’ kundi maging ang kanilang pagnanais at hangarin na makipag­negosasyon sa ‘inequitable provisions’ ng Concession Agreement.

Aniya, ito ay patunay umano na sinisikap at ginagawa ang lahat ng MWSS at ng Concession­aires na sundin at tumalima sa direktiba ng Pangulo na gampanan at isakaturapan ang bagong water con­ces­sion agreement pag­katapos ng 2022,  batay sa ginawang ‘draft’ ng Department of Justice.

“The continuity of the water sector PPP depends on strong communication channels and handholding engagement so that the basic access to water and wastewater services will not be jeopardized, which includes fully addressing and accomplishing the urgent call for new water and sewerage infrastruc­ture projects,” dagdag sa ipinalabas na statement ng MWSS administrator.
