Pagbubuo ng Code of Transportation and Commuter Safety isinulong ni Marcos

IDINIING ang pinakamahalaga ay pagtiyak sa kaligtasan at kapakanan ng mga ordinaryong pasahero, nanawagan si Senator Ferdinand “Bongbong” Marcos, Jr., kahapon sa mga kapwa niya mambabatas, na rebisahin, i-update o i-repeal ang ilang transportation law at pag-isahin bilang Code of Transportation and Commuter Safety.

Ayon kay Marcos, ang kasalukuyang batas kaugnay sa transportasyon ay halos regulasyon lamang para sa land, air and sea transport sectors, at ilan lamang ang tumatalakay kaugnay sa pagpapabuti sa pagtiyak ng kaligtasan at kapakanan ng mga pasahero.

Ang mga probisyon para sa kaligtasan ng mga pasahero ay nakasaad sa Articles 1755 hanggang 1763 ng New Civil Code of the Philippines.

Gayonman, ang mga probisyong ito ay hindi sapat para sa pagtiyak sa kaligtasan ng mga pasahero lalo na’t gumagamit sila ng pampublikong sasakyan.

Panahon na, ani Marcos, na ipunin ang mga probisyong ito sa hiwalay na Code na nagtataglay ng specific legal provisions na nagpapahayag ng karapatan ng mga pasahero, at safety measures na ipatutupad ng mga sasakyan o transport company para sa kanila.

“Our current transportation laws are meant as regulations to carriers and transport sectors. These are mostly directed at businesses. How about the ordinary commuter? What kinds of safeguards does the government give them? What rights do they have as commuters? I think it is time to review the provisions of the New Civil Code of the Philippines pertaining to commuters, lift and separate them from the Code, and create a New Code that expressly expands commuter rights and thereupon, create measures meant towards improving public transport infrastructure to be more “commuter-friendly” pahayag ng batang senador.

Naniniwala si Marcos, panahon na para bumuo ang gobyerno ng mga batas na mag-uutos sa pagtatatag ng commuter-friendly infrastructures at kasabay nito ang pagbubuo ng batas na magpapabuti sa maintenance service at tutugon sa crisis preparted protocols.

“It is the mandate of every carrier to take extraordinary diligence in their services. Extraordinary diligence has already been defined by our courts to mean more than the diligence that a dutiful father does to his children.

However, because there is no specific code that governs the transportation and commuter sectors in our country, this level or diligence is not at par with the expectations of the public, much less government.”
