PINAGTIBAY ng Supreme Court kahapon ang dismissal kay Cadet Jeff Aldrin Cudia mula sa Philippine Military Academy (PMA).
Sa ruling, sinabi ng SC na hindi nilabag ng PMA ang karapatan ni Cudia sa due process nang ipatupad ang ‘rules on discipline’, kabilang ang Honor Code, dahil sa pagsisinungaling.
Sinabi ng high tribunal, ang kaso ay “subsumed under (PMA’s) academic freedom because the establishment of rules governing unversity-student relations, particularly those pertaining to student discipline, may be regarded as vital, not merely to the smooth and efficient operation of the instution, but to its very survival.”
Napatunayan ng SC na guilty si Cudia ng “quibbling which constitutes lying,” nang ipaliwanag niyang ang nauna niyang kalse ay late nang idismis, kaya nahuli siya sa susunod niyang klase.
Ayon sa SC, ang “quiblling” ay sitwasyon na ang isang tao ay nagbubuo ng maling impresyon sa nakikinig sa kanya “by cleverly wording what he says, omitting facts or telling a partial truth.”
“(Cudia) cunningly chose words which led to confusion… There is manipulation of facts and presentation of untruthful explanation constitutive of an Honor Code violation,” dagdag ng SC.
