Kasong lasciviousness na isinampa ni Sandro vs Nones at Cruz ibinasura

IBINASURA ng Pasay Metropolitan Trial Court ang isa sa charges na isinampa laban sa independent contractors na sina Jojo Nones at Richard Cruz kaugnay ng umano’y sexual assault na inireklamo ni Sandro Muhlach.

Ayon sa Pasay Court, ang acts of lasciviousness  ay “overkill” dahil puwede itong maikonsiderang elemento ng rape through sexual assault.

Ayon sa Korte, “Indeed the acts of lasciviousness being complained of before this court are necessarily included in the charge of rape before the RTC.

“Again, the prosecution resorted to an overkilla by filing the instant information for Acts of Lasciviousness  when clearly the acts are constitutive and/or simultaneous and are deemed absorbed in the rape case with the alleged sole intent and purpose of arousing and ultimately gratifying the accused own sexual desires,” dagdag na pahayag ng Korte.
