Darryl Yap kinasuhan na ng cyberlibel sa Muntinlupa RTC

SINAMPAHAN na ng cyberlibel ang filmmaker na si Darryl Yapkaugnay ng kontrobersiyal na teaser ng pelikulang The Rapists of Pepsi Paloma.

Sa resolusyong inilabas ng Muntinlupa Regional Trial Court (RTC), nakitaan ng sapat na basehan ang inihaing kaso ni Vic Sotto kaya iniakyat na sa husgado mula sa fiscal’s office.

Sa tatlong pahinang dokumento na may petsang March 17, 2025, na pirmado ni Assistant City Prosecutor Elvin Keith Barrios, sinampahan ng cyberlibel si Yap.

Ayon sa resolusyon, “The undersigned Assistant City Prosecutor accuses DARRYL RAY SPYKE YAP y BALINGIT of the crime of Libel under Arts. 353 and 355 of the Revised Penal Code, as amended, in relation to violation of Sec.4(c)(4) of R.A. 10175, otherwise known as the Cybercrime Prevention Act of 2012.”

Binanggit din sa resolusyon na nakitaan ng probable cause ang reklamo dahil sa direktang pagbanggit sa pangalan ni Vic sa teaser ng pelikula ni Darryl.

Sa teaser ng pelikula, ipinakita ang palitan ng dialogue nina Gina Alajar (gumaganap bilanh Charito Solid) at Rhed Bustamante (gumaganap bilang Pepsi Paloma) na nabanggit ang pangalan ni Vic ukol da panggagahasa.

“The above-named accused, being a film director, screen writer and producer, using his personal Facebook account named ‘Darryl Yap,’ which account can only be accessed using information or computer technologies or through a computer system, with deliberate and malicious intent to tarnish or cast dishonor upon the reputation of one MARVIC ‘VIC’ SOTTO y CASTELO or to expose the latter to public contempt, hatred or ridicule…, did then and there willfully, unlawfully and feloniously compose, prepare, write, publish and post a teaser video of his film entitled ‘The Rapists of Pepsi Paloma’ (TROPP),” saad sa resolusyon.

“I HEREBY CERTIFY, that the crime or offense charged in this case has a prescribed penalty of not more than six (6) years of imprisonment without regard to fine and hence, an expedited preliminary investigation was conducted in this case pursuant to Section 8, Rule V of DOJDepartment Circular No. 28 series of 2024,” dagdag pa.

Inirekomenda ang P10,000 piyansa para sa kaso. (MVN)
