KABILANG sa mga delikado sa Anti-Terrorism Act of 2020 (ATA 2020) ang mga mahilig magpakana ng pang-aagaw sa kapangyarihan dahil saklaw ng krimeng terorismo ang seryosong pagsusulong ng destabilisasyon laban sa pamahalaan at may parusang habambuhay na pagkabilanggo.
“It is also clear that any terroristic act mentioned in Section 4 must be done ‘to intimidate the general public or a segment thereof, create an atmosphere or spread a message of fear, to provoke or influence by intimidation the government or any of its international organization, or seriously destabilize or destroy the fundamental political, economic, or social structures of the country, or create a public emergency or seriously undermine public safety,’ before the same can ripen to the crime of terrorism,” ayon kay Presidential Chief Legal Counsel Salvador Panelo sa isang kalatas.
Binigyan diin ni Panelo na hindi kasama sa depinisyon ng terorismo sa ATA ang advocacy, protest, dissent, stoppage of work, industrial or mass action, and other similar exercises of civil and political rights, which are not intended to cause death or serious physical harm to a person, to endanger a person’s life, or to create a serious risk to public safety.”
Taliwas aniya ito sa mga kritisismo na malabo ang kahulugan ng terorismo sa ATA.
Binibigyan aniya ng ATA ng legal na armas ang pamahalaan upang puksain ang terorismo kahit nasa antas pa lamang ng pagpaplano at bago mailunsad ang malupit na pag-atake kaya’t mapangangalagaan ang pambansang seguridad at maisusulong ang kapakanan ng sambayanang Filipino.
“The ATA will provide the government the legal weapon to ensnare the terrorists at their trail even before they can launch their ruthless and savage attacks against it thereby preserving its national security and promoting the general welfare of the Filipino people,” ani Panelo.
Pangunahin sa kinuwestiyon ng iba’t ibang grupo sa ATA ang Anti-Terrorism Council na itatalaga ni Pangulong Rodrigo Duterte ang mga bubuo na may kapangyarihang ‘basbasan’ ang mga awtoridad na umaresto at magkulong ng pinaghihinalaang terorista nang walang warrant of arrest mula tatlong araw hanggang 24 araw.
Matatandaan, mismong ang may-akda ng ATA na si Sen. Panfilo Lacson ay nasangkot na sa destabilisasyon laban sa administrasyong Arroyo at hanggang Amerika ay sumabit sa espionage nang madakip at mahatulan si dating FBI analyst Leandro Aragoncillo na nagbigay sa kanya ng classified informationa mula sa Federal Bureau of Investigation FBI.
