Kampo ni Bongbong maghahain ng cybercrime vs Smartmatic, Comelec IT rep

INIHAYAG ng kampo ni Vice Presidential candidate Senator Ferdinand “Bongbong” R. Marcos Jr. kahapon, maghahain sila ng isa pang set ng mga kasong kriminal laban sa Smartmatic executives at sa Commission on Elections (COMELEC) Information Technology (IT) representative dahil sa kanilang hindi awtorisadong pagbabago ng scrip sa transparency server ng poll body noong gabi ng halalan.

Sinabi ni Atty.  Jose Amor Amorado, pinuno ng Bongbong Marcos (BBM) Quick Count Center, ihahain nila ngayong araw sa Manila Prosecutor’s Office ang reklamong paglabag sa Cybercrime Prevention Act of 2010 (RA 10175) partikular ang Section 4 ng Chapter II ng nasabing batas.

Ayon kay Amorado, parurusahan sa nasabing batas ang mga paglabag na makaaapekto sa “confidentiality, integrity and availability” ng computer data and systems kabilang ang “illegal access of any part of a computer system without right.”

“We will file the appropriate complaint for violation of the Cybercrime Law before the Prosecutor’s office against Smartmatic and Comelec IT representative in the transparency server for opening the system without authority of the Comelec and instituting changes in the script,” pahayag ni Amorado.

Aniya, may sapat silang ebidensiya para makasuhan ang Smartmatic executives at Comelec IT representative base sa public documents at pahayag ng mismong Comelec na ang panghihimasok sa system ay walang awtorisasyon.

“It is res ipsa loquitor (the thing speaks for itself),” diin ni Amorado.

Idinagdag niyang hihiling sila ng Hold Departure Order (HDO) laban sa Smartmatic executives kapag nakarating na sa korte ang kaso.

Nauna rito, inihain ni Abakada Party-list Rep. Jonathan dela Cruz ang kasong kriminal kaugnay sa paglabag sa R.A. 8436 as amended by R.A. 9369 o Automated Election Law, sa Comelec laban kina Smartmatic Executive Marlon Garcia, Elie Moreno, Smartmatic Project Director;  Neil Banigued, miyembro ng Smartmatic Technical Support Team at Rouie Peñalba, IT Officer ng Comelec, bunsod nang kanilang hindi awtorisadong pagbabago sa script.

Kaugnay sa nalalapit na official canvassing ng mga boto, sinabi ni Amorado, hindi nila idi-delay ang proseso kundi susuriing mabuti ang bawat Certificate of Canvass (COC) lalo na’t maraming amended COCs ang ini-report sa kanila.

“Marami kaming natatanggap na amended COCs and we will have to look at them kaya nga kami dati nagsasabi na bakit kailangan mag-transmit agad kung hindi pa kompleto ang results kaya tuloy meron tayong mga amended COCs ngayon,” ayon kay Amorando.

Upang hindi ma-delay ang canvassing, sinabi ni Amorado, hihilingin nila sa Kongreso na i-set aside ang kuwestiyonableng  COCs at hayaan ang canvassing sa COCs na walang problema.

 ”We would request Congress that for the questionable COCs, i-set aside muna natin para mabigyan ng daan ‘yung mga unquestionable COC na puwede nang i-canvass. And in the process, we will present evidence why the COCs should be excluded from the canvass,” diin ni Amorado.

Dagdag ni Armoda, ang inagurasyon ng bagong Pangulo at Pangalawang Pangulo ay isasagawa sa Hunyo 30, kaya may sapat pang panahon ang Kongreso sa pag-canvass ng mga boto.

“We will not delay kasi ang inauguration naman sa President at Vice President ay sa June 30. We have more than enough time and while nagka-canvass, we still have time for the system audit kasi puwede naman itong simultaneous gawin,” dagdag ni Amorado.

Samantala, narito ang pahayag ni Atty. George Garcia, legal counsel ni Sen. Bongbong Marcos, sa pahayag ng Comelec IT experts na pinakialaman nila ang CCS noong gabi ng eleksiyon.

“We hope the Commission on Elections (COMELEC) will make public the list of provincial CCS or whatever CCS which were brought to Laguna for alleged repair due to non-transmission/failure to receive transmission. A satisfactory explanation as to why and how is strongly urged. This is one of those instances casting doubt on the purity of the recently concluded elections. The Filipino people deserves to know.
