NAIS nang ipaaresto ni Senate Committee on Women, Children and Family Relations Gender Equality chairperson Senator Risa Hontiveros si Kingdom of Jesus Christian (KOJC) leader Pastor Apollo Quiboloy.
Ayon sa Senadora, ilang beses nang inisnab ni Quiboloy ang subpoena ng senado upang sagutin ang akusasyon hinggil sa human trafficking laban.
Dahil dito nagmosyon si Hontiveros sa pagdinig at naghain ng cite for contempt laban kay Quiboloy kasunod ng pagpapalabas ng warrant of arrest upang tuluyan siyang mapadalo sa pagdinig ng senado.
“Pursuant to Section 18 of the Rules of the Senate, as chair of the Committee, with the concurrence of one member here with me (Senator Aquilino “Koko” Pimentel III), I cite in contempt Apollo Carreon Quiboloy for his refusal to be sworn or to testify before this investigation. This committee requests the Senate President to order his arrest so that he may be brought to testify,” ani Hontiveros.
Bago ang ‘contempt’ laban kay Quiboloy sinabi ni Hontiveros na lumiham sa kanya at kay Senate President Juan Miguel Zubiri ang abogado nitong si Melanio Balayan.
“With all due respect to Your Honors and the Senate as an institution, we hereby submit that the issuance and enforcement of the said Subpoena is in wanton violation of the fundamental and sacred constitutional rights of our Client against self-incrimination and the presumption of innocence until proven guilty beyond reasonable doubt. With the criminal charges against him being tried virtually in public through the [S]enate committee and all available media, our Client is now being humiliated, ridiculed, harassed and maligned at all media fronts with reckless abandon as if he was already a convict. The essence of due process of law—that hears before it condemns—is being rendered useless under the present circumstances. We thus invoke our Client’s right against further incrimination by recusing himself from the ongoing investigation,” bahagi ng binasang sulat ni Balayan.
Bagay na tinutulan ni Hontiveros dahil karapatan ng senado na magsagawa ng imbestigasyon at iginagalang ng senado ang karapatang pantao lalo ang pagiging inosente at self-incrimination sa mga testigong kanilang iniimbitahan.
“Madaling-madali na lang umiwas sa mga hearing ng Blue Ribbon ang mga tiwaling opisyal, sa mga imbestigasyon ng Public Order Committee ng mga sangkot sa mga krimen. Hindi po uubra ang ganitong mga excusea,” ani Hontiveros.
Matapos ang desisyon ng komite ng pag-aresto kay Quiboloy, agad na nagpahayag ng pagtutol si Senador Robin Padilla.
“Ipagpaumanhin po ninyo, akin pong tinututulan ang naging pasya na ma-contempt si Pastor Quiboloy, with all due respect, Ma’am,” ani Padilla.
Ani Hontiveros, mayroon pang ilang araw ang mayoryang miyembro ng komite para baguhin ang unang desisyon ng komite.
Samantala, nagsagawa ng kilos protesta sa labas ng gusali ng senado ang mga tagasuporta ni Quiboloy kaugnay ng banta ni Hontiveros na ipaaaresto ang kanilang lider kung patuloy na iisnabin ang imbestigasyon ng Senado.
