Selective justice hindi pinalusot (PCC supalpal sa CA)

SINOPLA ng Court of Appeals (CA) ang Philippine Competition Commission (PCC) makaraang aprubahan ang urgent motion ng Globe Telecom na pag-isahin ang petisyon nito at ng PLDT.

Nauna nang tinutulan ng PCC ang konsolidasyon ng mga kaso ng Globe at PLDT, isang hakbang ng anti-trust body na maituturing umanong isang ‘selective justice.’

Ayon kay Globe General Counsel Froilan Castelo, ang desisyon ng CA ay pagbasura sa alegasyon ng PCC na ‘forum shopping.’

“Globe has followed the rules, and that motion to consolidate is just in accordance with Rule 31 of the Rules of Court. This is only but fitting as all Globe’s actions on this matter are well within the bounds of the rules, especially that of PCC’s Memorandum Circular 2016-002. We are disappointed that it is the PCC itself that does not follow the rules – the Rules of Court when it opposes the consolidation of the cases; and their own rules, MC 2016-002,” wika ni Castelo.

Inaprubahan ng CA 6th Division ang konsolidasyon ng kaso ng Globe sa kautusan nito na may petsang Hulyo 28, 2016, at sinabing alinsunod ito sa  Section 1, Rule 31 ng Rules of Court.

Ang Globe at PLDT ay nagsampa ng magkahiwalay na petisyon upang obligahin ang PCC na ideklara ang transaksiyon bilang ‘deemed approved’ sa ilalim ng kanilang  MC 2016-002.

Sa kanilang urgent motion for immediate consolidation, ipinaliwanag ng Globe na ang pagkakatulad ng mga isyu at ‘factual antecedents’ na iniharap sa mga petisyon ng Globe at PLDT ay malinaw.

Idinagdag ni Castelo, maliwanag na nilabag ng PCC ang sariling alituntunin sa pagsasabing ang dalawang telcos ay nabigong tumugon sa sarili nitong kautusan.

“We urge the PCC to uphold the law which is also their mandate.  For business, their inconsistent application of the law is dangerous,” ani Castelo.

Taliwas sa pahayag ng PCC na hindi nakikipagtulungan ang telcos, sinabi ng Globe na nakikipag-ugnayan sila sa government body. Nagkakaloob sila nang higit pa sa mga kinakailangang impormasyon at dokumento.

“These submissions were done in good faith and went beyond what the PCC actually requires by their own rules.  In addition to these, Globe even sought a dialogue with the PCC to explain its position and answer any concern the PCC may have regarding the transaction,” diin ni Castelo.
