SINOPLA ni dating Supreme Court Senior Associate Justice Antonio Carpio si Senate President at Impeachment court presiding officer Francis “Chiz” Escudero sa pagbibigay ng komento ukol sa impeachment case laban kay Vice President Sara Duterte.
Ipinaalala ni Carpio, hindi siya nagbigay ng anumang komento noon kaugnay sa pagbasura ng Senado sa impeachment case ni dating Ombudsman Merceditas Gutierrez dahil miyembro at bahagi siya ng Korte Suprema.
“I was in the Supreme Court since 2001, and as a member of the Supreme Court, I cannot be complaining because that case could reach us,” paglilinaw ni Carpio.
Ang pahayag ni Carpio ay kaugnay sa paghawak ng Senado sa impeachment case bilang impeachment court.
“[T]here is a provision in the Senate rules on impeachment. It says, the presiding officer and the senator-judges shall refrain from commenting on the merits of the impeachment case. So dapat sila huwag mag-comment,” ani Carpio sa isang panayam.
Binigyang-linaw ni Carpio na maaari na siyang magbigay ng komento sa kasalukuyan dahil nasa pribado na siyang buhay bilang mamamayan ng bansa.
“[T]he gag rule is there in the Senate rules. The Senate — the presiding officer, and the senator-judges — shall refrain from commenting publicly on the merits of the impeachment case,” giit ni Carpio.
Magugunitang noong 10 Hunyo ay nag-convene ang Senado bilang impeachment court, kung kailan sa botong 18-5 ay ibinalik sa Kamara ang article of impeachment sa pagtitiyak na hindi nila tinatalikuran ang kanilang resposibilidad sa reklamo kasunod ng mosyon na inihain ni Senador Ronald “Bato” dela Rosa na inamyendahan sa huli ni Senador Alan Peter Cayetano.
Inilinaw ni Carpio na hindi maikokompara ang sitwasyon ni Gutierrez dahil nagbitiw na siya sa puwesto at hindi na siya public officer kung kaya’t wala nang dahilan upang magkaroon pa ng paglilitis kompara sa kaso ni Duterte na hanggang sa kasalukuyan ay nanatili pa rin sa kanyang puwesto.
Nanindigan si Carpio na kung sa kasalukuyan ay bahagi pa siya ng Korte Suprema o ng impeachment court ay hindi siya maglalakas ng loob na magbigay ng kahit anong komento ukol sa kaso ni Duterte.
Kaugnay nito, suportado ni constitutional law professor and lawyer Howard Calleja ang bagong pahayag ni Carpio.
Ayon kay Calleja marapat lamang na manahimik ang senator-judges bilang bahagi ng kanilang judicial ethics.
“Justice Carpio was a member of the Supreme Court when former Ombudsman Gutierrez was impeached. Of course, Justice Carpio did not comment because a sitting magistrate does not comment on those matters that may reach the Supreme Court. With more reason that a senator-judge in impeachment proceedings should not comment on matters already pending before the impeachment court,” ani Calleja.
