MATAPOS mabigo si Senate Minority Leader Aquilino “Koko” Pimentel III na kombinsihin si Senate President Francis “Chiz” EScudero na agarang kumilos ukol sa impeachment complaint laban kay Vice President Sara Duterte na isinumite sa senado ay nanawagan naman siya kay Senate Majority Leader Francis “Tol” Tolentino na simulan nang ‘i-dribble’ ang bola upang umusad na ang reklamo.
Ayon kay Pimentel, maaari nang mag-set ng stage para sa impeachment si Tolentino dahil ito ang itinatadhana ng Konstitusyon.
“Preparatory work for the impeachment can proceed immediately as these actions are separate and distinct from the legislative functions of Congress. We have a constitutional duty that must take precedence over our reelection bid. While we may be busy with our campaigns, the best campaign is fulfilling our constitutional responsibilities. I trust that the upcoming election will not interfere with our mandate,” ani Pimentel.
Tinukoy ni Pimentel na ang kanyang liham kay Escudero ay ini-refer sa committee on rules na aniya ay si Tolentino ang pinuno.
“The Senate’s committee on rules must forthwith, immediately, right away, and without delay review the impeachment guidelines. The committee can either reaffirm the existing rules in their entirety or to propose targeted amendments that better align with the constitutional intent. The legislative calendar is different from the court calendar,” paglilinaw ni Pimentel.
Iginiit ni Pimentel na hindi dapat magtalo sa sinasabing Senate Legislative calendar dahil ang senado ay nanatiling senado at maaring magdeklara para ma-convene bilang impeachment court na aniya ay iba ang court calendar sa legislative calendar kung kaya’t maaari nang umaksiyon bago pa man ang 2 Hunyo ng taong kasalukuyan.
Binigyang-linaw ni Pimentel, ang pagpapaliban ng paglilitis hanggang 2 Hunyo ay magiging taliwas sa mandato ng konstitusyon na ang impeachment trial ng senado ay dapat kagyat na magsimula.
“The Senate can make a decision to convene as an impeachment court and come up with its own court calendar separate from its legislative calendar. Ang sabi sa Constitution, ang sabi doon isunod agad ang paglilitis sa senado. Ano naman ang meaning ng agad? E ordinary meaning din ‘yan mabilis, dagli-dagli, mayroon pa ngang malalim na tagalog karakaraka,” dagdag ni Pimentel.
Naniniwala si Pimentel na maaaring magsimula ang senado sa isang preliminary ngayong Marso at ipagpaliban ang presentasyon ng mga testigo hanggang matapos ang halalan.
Ngunit, aniya, ang mga pagpapaliban ay malaking sampal sa tunay na layunin ng mga gumawa ng batas at ang ‘spirit’ ng konstitusyon na ang trial ng senado ay dapat agad magsimula.
“Gusto naming makita o dapat naming makita what is now the level of interest among senators over this case. Kung nagpatawag ang Senate President ng all-senators caucus and yet there is no quorum even in that caucus, that is a reflection of, you know, more than one half do not have this in their radar, do not consider this completely their priority. The Senate must address the impeachment complaint against Vice President Sara Duterte with the seriousness and speed it deserves. It is time for the leadership to take the lead in ensuring the Constitution is followed,” pagwawakas ni Pimentel.
Magugunitang iminungkahi ni Pimentel kay Escudero na agarang magpatawag ng all senators’ caucus bukod pa sa nauna niyang liham dito.
