10-taon kulong vs Intramuros ex-administrator (Sa anomalous property lease)

HINATULAN ng Sandigan­bayan si dating Intramuros Administration chief Dominador Ferrer Jr., ng anim hanggang sampung taon kulong dahil sa maanomalyang pag-lease sa dalawang government pro­perties ng pribadong kompanya noong 1998.

Si Ferrer ay napatunayang guilty sa pagkakaloob ng “unwarranted benefits” sa Offshore Construction and Development Company (OCDC) para sa lease contracts nito sa Baluarte de San Andres at Baluarte de San Francisco nang walang public bidding, ayon sa Office of the Ombudsman.

Ito ay paglabag sa 1989 joint circular ng Department of Budget and Management, Depart­ment of Environment and Natural Resources and the Department of Public Works and High­ways, pahayag ng Om­buds­man sa reklamo nito.

Inakusahan din ng Ombuds­man ang dating Intramuros administrator ng paglabag sa Intramuros Charter at sa National Building Code sa pagpapa­hintulot ng konstruksiyon ng bagong mga estruktura sa leased areas nang walang ano mang building permit o clearance.

Sa desisyong inilabas noong 11 Mayo 2018, pinagtibay ng korte ang pananagutan ni Ferrer sa kapabayaan dahil sa pagpa-p­ahintulot ng development sa leased properties bagama’t ang OCDC ay kulang sa required permits.

“Accused Ferrer’s own testimony and acts reveal that, at the very least, he had indeed exhibited gross inexcusable negligence in allowing the lessees to develop and cons­truct on the leased premises, even as their compliance with requirements remained defi­cient, and with knowledge that such was in contravention of his duties under the Intramuros Charter,” ayon sa korte.

Ang desisyon ay isinulat ni Sandiganbayan 2nd Division Chairperson Oscar Herrera Jr., at sinang-ayonan nina Asso­ciate Justices Michael Frederick Musngi at Lorifel Pahimna.
